APPROPRIATIONS - HEALTH EDUCATION PROGRAMS - STATE BOARD OF EDUCATION -
Appropriates $7,103,700 to the State Board of Education and the Board of
Regents of the University of Idaho for Health Education Programs including
the WOI Veterinary Education Program, WWAMI Medical Education Program,
Idaho Dental Education Program, WICHE and University of Utah Medical
Education Program, and the Family Practice Residency Program for fiscal
year 2002; limits the number of full-time equivalent positions to 20.39;
and reappropriates any unexpended and unencumbered fund balances for

  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE HEALTH EDUCATION PROGRAMS FOR FISCAL  YEAR  2002;
  3        LIMITING  THE  NUMBER  OF  FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING
  4        CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES FOR  THE  SEVERAL  DESIGNATED
  5        PROGRAMS; AND SETTING FORTH CONDITIONS FOR THE REAPPROPRIATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  There  is  hereby appropriated to the Board of Regents of the
  8    University of Idaho and the State Board of Education the following amounts, to
  9    be expended for the designated programs according to  the  designated  expense
 10    classes  from  the  listed funds for the period July 1, 2001, through June 30,
 11    2002:

  7        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the agency  is
  8    authorized  no  more  than twenty and thirty-nine hundredths (20.39) full-time
  9    equivalent positions at any point during the period July 1, 2001, through June
 10    30, 2002, for the programs specified in Section 1 of this act, unless specifi-
 11    cally authorized by the Governor. The Joint  Finance-Appropriations  Committee
 12    will be notified promptly of any increased positions so authorized.
                                                                        
 13        SECTION  3.  There is hereby reappropriated to the Board of Regents of the
 14    University of Idaho and to the State Board of Education for the WOI Veterinary
 15    Education Program, WWAMI Medical Education Program, IDEP Dental Education Pro-
 16    gram, WICHE and University of Utah Medical Education Program, and Family Prac-
 17    tice Residencies Program the unexpended and unencumbered balance of any appro-
 18    priation made to each respective program under Section 1, Chapter 380, Laws of
 19    2000, for each respective program to be used for nonrecurring expenditures for
 20    the period July 1, 2001, through June 30, 2002.
                                                                        
 21        SECTION 4.  The reappropriation granted in Section 3 of this act shall  be
 22    subject to the following provisions:
 23        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
 24    June 30, 2001, is zero, the reappropriation for the General Fund in Section  3
 25    of this act is hereby declared to be null and void.
 26        (2)  If  the  unexpended  and  unencumbered balance in the General Fund on
 27    June 30, 2001, is greater than zero but less than the total General  Fund  re-
 28    appropriation authority granted to all state agencies, the amounts reappropri-
 29    ated in Section 3 of this act shall be in the proportion that the reappropria-
 30    tion  for each respective program bears to the total General Fund reappropria-
 31    tion authority granted to all state agencies.

This is the FY 2002 appropriation for the five Health Education Programs: the WOI Veterinary Education Program, the WWAMI Medical Education Program, the Idaho Dental Education Program, the combined University of Utah Medical Education and the Western Interstate Commission for Higher Education programs, and the Family Practice Residencies Program.
