  1                                        AN ACT
  2    RELATING TO THE LIEUTENANT GOVERNOR; AMENDING SECTION 67-809, IDAHO  CODE,  TO
  3        INCREASE  THE  RATE OF PER DIEM THE LIEUTENANT GOVERNOR SHALL RECEIVE WHEN
  4        THE LEGISLATURE IS IN OR OUT OF SESSION AND TO MAKE TECHNICAL CORRECTIONS;
  5        AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 67-809, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        67-809.  DUTIES  OF  LIEUTENANT-GOVERNOR LIEUTENANT GOVERNOR -- ACTUAL AND
 10    NECESSARY EXPENSES. (1) The lieutenant-governor lieutenant governor shall per-
 11    form on a day-to-day day to day basis such duties in and for the government of
 12    this state as the governor may from time-to-time  time  to  time  direct.  The
 13    lieutenant-governor  lieutenant  governor shall perform such additional duties
 14    as the governor may deem necessary and desirable to promote the improvement of
 15    state government and the development of  the  human,  natural  and  industrial
 16    resources  of  this  state.  At  the  written  direction  of the governor, the
 17    lieutenant-governor lieutenant governor may represent the  state  in  negotia-
 18    tions,  compacts,  hearings  and  other matters dealing with the states or the
 19    federal government. He shall cooperate with all state and  local  governmental
 20    agencies  to promote and encourage the orderly development of the resources of
 21    Idaho.
 22        The lieutenant-governor lieutenant governor shall also exercise the powers
 23    and privileges of the office of governor and presidency of the senate as  pro-
 24    vided  by article IV, sections 12 and 13, article IV of the Idaho constitution
 25    of the state of Idaho.
 26        (2)  The lieutenant-governor lieutenant  governor  shall  be  entitled  to
 27    receive the following expense allowances:
 28        (a)  As unvouchered expense allowances:
 29             (i)  While  performing  the duties of acting governor, the difference
 30             between the daily salary of lieutenant-governor  lieutenant  governor
 31             and  the  daily salary of governor, which amount shall be in addition
 32             to the salary as lieutenant-governor lieutenant governor. Such amount
 33             shall not be paid for any day on which the lieutenant-governor  lieu-
 34             tenant  governor claims an unvouchered expense allowance as president
 35             of the senate.
 36             (ii)  For each day spent serving as president of the senate during  a
 37             legislative  session,  the  sum of forty-four dollars ($44.00) if the
 38             lieutenant-governor does not maintain his primary  residence  in  Ada
 39             County.
 40             (iii)  For each day spent serving as president of the senate during a
 41             legislative  session,  the sum of twenty-five dollars ($25.00) if the
 42             lieutenant-governor maintains his primary residence in Ada County per
 43             diem authorized for a member of the legislature by the citizen's com-

  1             mittee on legislative compensation.
  2             (ivii)  Actual  mileage  expense  reimbursement  for  coming  to  and
  3             returning from any regular, extraordinary or  organizational  session
  4             of  the legislature at the same rate as mileage expense reimbursement
  5             is made for other state officers and employees.
  6             (iv)  For  each  day  actually  spent  in  the  office   serving   as
  7             lieutenant-governor  lieutenant governor while the legislature is not
  8             in session, the sum of forty-four dollars ($44.00) if the  lieutenant
  9             governor  does  not maintain his primary residence in Ada County same
 10             daily amount of per diem enumerated in subsection (2)(a)(ii) of  this
 11             section.
 12             (vi)  For   each   day  actually  spent  in  the  office  serving  as
 13             lieutenant-governor lieutenant governor when the legislature  is  not
 14             in   session,   the  sum  of  twenty-five  dollars  ($25.00)  if  the
 15             lieutenant-governor lieutenant governor maintains his  primary  resi-
 16             dence in Ada Ccounty.
 17        (b)  As vouchered expense allowances:
 18             (i)  Actual  and  necessary expenses incurred while serving as presi-
 19             dent of the senate during a legislative session, subject to the  same
 20             requirements and limitations as if a member of the legislature.
 21             (ii)  Actual   and  necessary  expenses  incurred  while  serving  as
 22             lieutenant-governor lieutenant governor or as acting governor.
 23        (3)  Unvouchered expense allowances and  vouchered  expense  reimbursement
 24    for  duties performed as president of the senate shall be paid from the legis-
 25    lative fund. All other compensation and/or allowances for duties performed  as
 26    the  lieutenant-governor lieutenant governor shall be paid from the appropria-
 27    tion made for the office of the lieutenant-governor lieutenant governor.
 28        (4)  The actual and necessary expenses of the lieutenant-governor lieuten-
 29    ant governor while performing his official duties as lieutenant-governor lieu-
 30    tenant governor or as acting governor are hereby expressly exempted  from  the
 31    provisions  of  sections  67-2007  and  section  67-2008, Idaho Code (Standard
 32    Travel Pay and Allowance Act of 1949).
                                                                        
 33        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 34    declared to exist, this act shall be in full force and effect on and after its
 35    passage and approval.

Statement of Purpose / Fiscal Impact


	                STATEMENT OF PURPOSE		

                             RS 11272

When the legislature is in session, a lieutenant governor who does not 
maintain a primary residence in Ada County is entitled to a per diem 
of $44 per day. In addition, a lieutenant governor who does not 
maintain a primary residence in Ada County is entitled to a per diem 
of $44 per day for each day actually spent in the office while the 
legislature is not in session. This legislation would amend Idaho 
Code to adjust the amount of per diem received by the lieutenant 
governor to reflect the same amount received by legislators, as 
determined by the citizens' committee on legislative compensation.



                          FISCAL IMPACT



The fiscal impact to the General Fund while the legislature is in 
session will be the same amount for an individual legislator. The 
total per diem for a legislator who maintains a second residence in 
Ada County during a regular session is approximately $8,400. The 
fiscal impact to the General Fund while the legislature is not in 
session will depend upon the number of days actually spent in the 
office by the lieutenant governor multiplied by $99 per day.
