SENATE CONCURRENT RESOLUTION NO. 110
BY HEALTH AND WELFARE COMMITTEE
1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REQUESTING THE DEPARTMENT OF HEALTH
3 AND WELFARE TO RESEARCH AND ADAPT THE AGED AND DISABLED WAIVER AND/OR
4 STATE PLAN PERSONAL CARE SERVICES TO PROVIDE SERVICES NEEDED BY MENTALLY
5 ILL, DEVELOPMENTALLY DISABLED OR MULTIPLE DIAGNOSED INDIVIDUALS.
6 Be It Resolved by the Legislature of the State of Idaho:
7 WHEREAS, there are numerous individuals residing in the state of Idaho
8 with mental illness, developmental disabilities or multiple diagnoses; and
9 WHEREAS, many of these citizens reside in state institutions and are at
10 risk of imminent institutionalization or reside in programs funded solely by
11 state General Funds; and
12 WHEREAS, there are currently no Medicaid programs available to provide
13 care for these individuals.
14 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
15 of the Fifty-sixth Idaho Legislature, the Senate and the House of Representa-
16 tives concurring therein, that the Director of the Department of Health and
17 Welfare is requested to research and modify the circumstances under which the
18 Aged and Disabled Waiver and the State Plan Personal Care Services may be uti-
19 lized to address the needs of mentally ill, developmentally disabled, and mul-
20 tiple diagnosed individuals who may, by use of these services, save General
21 Fund dollars now being used to maintain the individual in state hospitals,
22 correctional facilities and other care settings funded solely by state General
23 Funds.
24 BE IT FURTHER RESOLVED that at such time as the Department of Health and
25 Welfare adopts other programs for these individuals more appropriate to their
26 conditions, this modification of the Aged and Disabled Waiver and/or State
27 Plan Personal Care Services would no longer apply. The pursuit of modifica-
28 tions to the Aged and Disabled Waiver and/or State Plan Personal Care Services
29 shall ensure that it will not violate any conditions of participation by the
30 state of Idaho in the Medicaid program.
STATEMENT OF PURPOSE

The Director of the Department of health and Welfare is requested
to research and modify the circumstances under which the Aged and
Disabled Waiver and the State Plan Personal Care Services may be
utilized to address the needs of mentally ill, developmentally
disabled, and multiple diagnosed individuals who may, by use of
these services, save General Fund dollars now being used to
maintain the individual in state hospitals, correctional
facilities and other care settings funded soley by state General
Funds. By requesting the Department of health and Welfare to
research and adopt the (A&D) waiver (Aged and Disabled) and/or
the companion State Plan Personal Care Services Program and
accommodate the individuals left out of the successful effort of
the last two years.
Fiscal Impact
Currently there are an estimated 2,200 individuals residing in
Residential and Assisted Living Facilities; Certified Family
Homes, or Wavered 725 Facilities that are receiving State
assistance. Of these, 475 are only eligible for funding from the
Adult Aged Blind and Disabled (AABD) Program which is 100% State
General Funds. This is due to the fact that they are primarily
mentally ill, developmentally disabled or have multiple diagnosis
that primarily is behaviorally related. The breakdown of Levels
of care is: 68at Level 1

The average client contributes $495 a month to their care and the
State adds: $292per month for Level 1
$355per month for Level 2
$424per month for Level 3
By modifying the two Medicaid Programs used to pay for all the
other recipients in these facilities, it is anticipated that almost
$1 million dollars ($925,038.00) can be saved from the State
General Fund and bring funding levels for care in line with what
the other populations in Residential and Assisted Living Facilities
and Certified Family Homes resource needs are. This savings
results from the Medicaid programs receiving approximately 70%
Federal match reducing the States share down to 30%. Should this
change result in additional individuals becoming eligible for
service, the savings would generate an additional $3,083,426.00
from Federal match which would more than cover any increase in
utilization and still leave a surplus.
