  1                                        AN ACT
  2    RELATING TO THE IDAHO CERTIFIED  SHORTHAND  REPORTERS  ACT;  AMENDING  SECTION
  3        54-3109, IDAHO CODE, TO REVISE THE QUALIFICATIONS FOR ISSUANCE OF A TEMPO-
  4        RARY CERTIFIED SHORTHAND REPORTER CERTIFICATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 54-3109, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        54-3109.  QUALIFICATIONS FOR TEMPORARY CERTIFICATION -- RENEWAL.  (a)  Any
  9    (1)  A  temporary certified shorthand reporter certificate may be issued to an
 10    applicant who is a citizen of the United States pays the fees required by  the
 11    provisions of this chapter and who:
 12        (a)  Is of good moral character, having; and
 13        (b)  Has  graduated  from  an  accredited high school or having had has an
 14        equivalent education, shall be entitled to a temporary certified shorthand
 15        reporter certificate upon proof that he has been; and
 16        (c)  Is currently licensed in good standing in another state as  a  certi-
 17        fied  shorthand reporter, or its equivalent, or has otherwise demonstrated
 18        his proficiency by a certificate from an agency of another state,. The  or
 19        has  graduated  from  a  national  shorthand  reporter  association (NSRA)
 20        approved school; and
 21        (d)  Meets the experience qualifications that the board shall  may  estab-
 22        lish  by rule.the criteria for determining the necessary experience quali-
 23        fications under this paragraph.
 24        (2)  The application shall be upon such form as prescribed  by  the  board
 25    and the board may in its discretion make additional investigation and inquiry,
 26    or  require further information from the applicant, as it shall deem necessary
 27    in order to make a determination of the qualifications of the applicant.  Upon
 28    fulfillment  of  these qualifications the board shall issue a temporary certi-
 29    fied shorthand reporter certificate upon payment of the fees required by  this
 30    act.
 31        (b3)  All  temporary  certified  shorthand  reporter certificates shall be
 32    issued for a period of one (1) year and may be renewable for  a  single  addi-
 33    tional  period of one (1) year upon the payment of the fees prescribed in sec-
 34    tion 54-3110, Idaho Code, and upon a showing of just cause.

The proposed changes clarify the qualifications necessary for
issuance of a temporary certificate to practice shorthand
reporting by amending Section 54-3109, Idaho Code.

                          FISCAL IMPACT

There will be no fiscal impact to the general fund or other state
funds or to local government funds.
