WATER/SEWER DISTRICT BOARD - Amends existing law to increase the maximum
allowable compensation for each member of a board of directors of a water
district or a sewer district from fifty dollars to one hundred fifty

  1                                        AN ACT
  2    RELATING TO WATER AND SEWER DISTRICTS; AMENDING SECTION 42-3209,  IDAHO  CODE,
  3        TO  INCREASE THE MAXIMUM ALLOWABLE COMPENSATION FOR EACH MEMBER OF A BOARD
  4        OF DIRECTORS FROM FIFTY DOLLARS TO ONE  HUNDRED  FIFTY  DOLLARS  FOR  EACH
  5        MEETING.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 42-3209, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        42-3209.  ORGANIZATION OF BOARD -- ACCOUNTS OF TREASURER  --  COMPENSATION
 10    OF MEMBERS -- ANNUAL AUDIT -- REMOVAL OF DIRECTORS. After taking oath and fil-
 11    ing  bonds,  the  board shall choose one (1) of its members as chairman of the
 12    board and president of the district, and shall elect a secretary and  a  trea-
 13    surer  of  the board and of the district, who may or may not be members of the
 14    board. The secretary and the treasurer may be one  person.  Such  board  shall
 15    adopt  a  seal and the secretary shall keep, in a well-bound book, a record of
 16    all its proceedings, minutes of all meetings, certificates,  contracts,  bonds
 17    given by employees and all corporate acts which shall be open to inspection of
 18    all  owners  of  real property in the district, as well as to all other inter-
 19    ested parties.
 20        The treasurer shall  keep  strict  and  accurate  accounts  of  all  money
 21    received  by  and  disbursed  for  and on behalf of the district, in permanent
 22    records. He shall file with the clerk of the court, at the expense of the dis-
 23    trict, a corporate fidelity bond in an amount not less than five thousand dol-
 24    lars ($5,000), conditioned on the faithful performance of the  duties  of  his
 25    office.
 26        Each  member  of the board shall receive as compensation for his service a
 27    sum not in excess of one hundred fifty dollars ($150.00) per meeting,  payable
 28    monthly.  No member of the board shall receive any compensation as an employee
 29    of the district or otherwise, other than that herein provided, and  no  member
 30    of  the board shall be interested in any contract or transaction with the dis-
 31    trict except in his official representative capacity.
 32        It shall be the duty of the board of directors to cause  an  audit  to  be
 33    made of all financial affairs of the district during each year ending November
 34    30th as required in section 67-450B, Idaho Code.
 35        The  court  having  jurisdiction  of  the district shall have the power to
 36    remove directors for cause shown, on petition, notice and hearing.
