HOUSE BILL NO. 654

1 AN ACT
2 RELATING TO MOTOR VEHICLE LAW AND RULES OF THE ROAD; AMENDING SECTION 49-615,
3 IDAHO CODE, TO PROVIDE THAT DRIVERS SHALL EXERCISE PROPER PRECAUTION TO
4 ENSURE THAT NO OBJECT OR DEBRIS CAPABLE OF CAUSING PROPERTY DAMAGE OR PER-
5 SONAL INJURY SHALL FALL FROM OR OTHERWISE BE PROPELLED FROM ANY PORTION OF
6 THE DRIVER'S VEHICLE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 49-615, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 49-615. DRIVERS TO EXERCISE DUE CARE. Notwithstanding other provisions of
11 this title or the provisions of any local ordinance, every driver of a vehicle
12 shall exercise due care to avoid colliding with any pedestrian or any person
13 propelling a human-powered vehicle and shall give an audible signal when nec-
14 essary. Every driver shall exercise proper precaution upon observing any child
15 or any obviously confused, incapacitated or intoxicated person. Every driver
16 shall exercise proper precaution to ensure that no object or debris capable of
17 causing property damage or personal injury shall fall from or otherwise be
18 propelled from any portion of the driver's vehicle.

STATEMENT OF PURPOSE
RS 12082
The purpose of this legislation is to make it clear that the
driver of a vehicle is responsible for any object or debris that
falls from their vehicle.
FISCAL IMPACT
There will be no impact on the General fund, but this legislation may
impact county budgets dependent upon enforcement.
