|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT RESOLUTION NO. 4 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO ARTICLE I, OF THE CONSTITUTION OF THE STATE OF 3 IDAHO, BY THE ADDITION OF A NEW SECTION 23, ARTICLE I, TO PROVIDE THAT 4 HUNTING, TRAPPING AND FISHING AND THE TAKING OF GAME ANIMALS, GAME BIRDS 5 AND GAME FISH ARE A VALUED PART OF OUR HERITAGE AND THEREFORE THE RIGHT 6 TO HUNT, TRAP AND FISH WILL BE FOREVER PRESERVED FOR THE PEOPLE OF THE 7 STATE OF IDAHO WITHIN THE BOUNDARIES OF THE STATE OF IDAHO AND THAT ALL 8 WILDLIFE SHALL BE MANAGED BY REASONABLE RESTRICTIONS, LAWS AND RULES; 9 STATING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECTING THE LEG- 10 ISLATIVE COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND DIRECTING 11 THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED 12 BY LAW. 13 Be It Resolved by the Legislature of the State of Idaho: 14 SECTION 1. That Article I, of the Constitution of the State of Idaho be 15 amended by the addition of a NEW SECTION, to be known and designated as Sec- 16 tion 23, Article I, of the Constitution of the State of Idaho, and to read as 17 follows: 18 SECTION 23. RIGHT TO HUNT, TRAP AND FISH. Hunting, trapping, 19 and fishing and the taking of game animals, game birds and game fish 20 are a valued part of our heritage and therefore the right to hunt, 21 trap and fish will be forever preserved for the people of the state 22 of Idaho within the boundaries of the state of Idaho. All wildlife 23 shall be managed by reasonable restrictions, laws and rules. 24 SECTION 2. The question to be submitted to the electors of the State of 25 Idaho at the next general election shall be as follows: 26 "Shall Article I, of the Constitution of the State of Idaho be amended by 27 the addition of a new Section 23, to provide that hunting, trapping, and fish- 28 ing and the taking of game animals, game birds and game fish are a valued part 29 of our heritage and therefore the right to hunt, trap and fish will be forever 30 preserved for the people of the state of Idaho within the boundaries of the 31 state of Idaho and that all wildlife shall be managed by reasonable restric- 32 tions, laws and rules?". 33 SECTION 3. The Legislative Council is directed to prepare the statements 34 required by Section 67-453, Idaho Code, and file the same. 35 SECTION 4. The Secretary of State is hereby directed to publish this pro- 36 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE RS 12173 This bill will forever preserve the right to hunt, fish, and trap, as they are a valued part of Idaho's heritage. All wildlife shall be managed by reasonable restrictions, laws, and rules. FISCAL IMPACT As estimated by the Secretary of State's office, this will cost the general fund approximately $25,000.
