|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1385 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO TENANCY AT WILL; AMENDING SECTION 55-208, IDAHO CODE, TO PROVIDE 3 FOR A TENANT'S TERMINATION OF A TENANCY AT WILL AND TO MAKE TECHNICAL COR- 4 RECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 55-208, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 55-208. TERMINATION OF TENANCY AT WILL. A tenancy or other estate at 9 will, however created, may be terminated: 10 (1) Bby the landlord's giving notice in writing to the tenant, in the 11 manner prescribed by theCcode ofCcivilPprocedure, to remove from the prem- 12 ises within a period of not less than one (1) month, to be specified in the 13 notice; or 14 (2) By the tenant giving notice in writing to the landlord that the ten- 15 ant will be vacating the premises, on a date as specified in the notice, but 16 not less than one (1) month from the date of notice.
STATEMENT OF PURPOSE RS 11802 This bill would impose on the tenant the same legal duty of lease hold termination for month to month tenancy as exists for the landlord.
