SPEAKER Requested by: Department of Insurance 1 AN ACT 2 RELATING TO INSURANCE; AMENDING CHAPTER 13, TITLE 41, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW SECTION 41-1334, IDAHO CODE, TO LIMIT THE DISCLOSURE OF NON- 4 PUBLIC PERSONAL INFORMATION BY PERSONS REGULATED BY THE DEPARTMENT OF 5 INSURANCE, TO PROVIDE FOR THE ADOPTION OF RULES AND TO PROVIDE THAT NOTH- 6 ING IN THIS ACT SHALL BE CONSTRUED TO CREATE A PRIVATE CAUSE OF ACTION; 7 AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 13, Title 41, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 41-1334, Idaho Code, and to read as follows: 12 41-1334. DISCLOSURE OF NONPUBLIC PERSONAL INFORMATION. (1) No person 13 required to be licensed or authorized pursuant to title 41, Idaho Code, shall 14 disclose any nonpublic personal information contrary to the provisions of 15 title V of the Gramm-Leach-Bliley act of 1999, public law 106-102. 16 (2) The director may adopt rules necessary to carry out this section. 17 The rules shall be consistent with the provisions of title V of the Gramm- 18 Leach-Bliley act of 1999. 19 (3) Nothing in this section shall be construed to create a private cause 20 of action. 21 SECTION 2. An emergency existing therefor, which emergency is hereby 22 declared to exist, this act shall be in full force and effect on and after its 23 passage and approval.
STATEMENT OF PURPOSE
RS 11412
In 1999, the United States Congress passed the Gramm-Leach-Bliley
Act (public law 106-102). Title V of this Act contains a section
governing the disclosure of "nonpublic personal information" by
"financial institutions" as those terms are defined within the Act.
Under Title V, state insurance regulators are responsible for
enforcing the Act's privacy protections with respect to financial
institutions engaged in the business of insurance. This legislation
provides the Director of the Department of Insurance the authority to
adopt rules to implement the privacy requirements of the
Gramm-Leach-Bliley Act of 1999.
FISCAL IMPACT
There is expected to be no fiscal impact to the state's general
fund.
