  2    RELATING TO COMPENSATION OF HIGHWAY DISTRICT COMMISSIONERS;  AMENDING  SECTION
  3        40-1314,  IDAHO CODE, TO PROVIDE THAT IT SHALL BE THE DUTY OF THE BOARD OF
  4        HIGHWAY DISTRICT COMMISSIONERS OF EACH HIGHWAY DISTRICT TO FIX THE  ANNUAL
  5        SALARIES OF THE HIGHWAY DISTRICT COMMISSIONERS COMMENCING ON OCTOBER 1 AND
  6        FOR  THE NEXT ENSUING YEAR AND TO PROVIDE NOTICE REQUIREMENTS FOR PROPOSED
  7        SALARIES.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 40-1314, Idaho Code, be, and the same  is  hereby
 10    amended to read as follows:
                                                                        
 11        40-1314.  COMPENSATION OF HIGHWAY DISTRICT COMMISSIONERS, OFFICERS, AGENTS
 12    AND  EMPLOYEES. (1) It shall be the duty of the board of highway district com-
 13    missioners of each highway district to fix the annual salaries of the  highway
 14    district  commissioners commencing on October 1 and for the next ensuing year.
 15    The proposed salaries shall be published in accordance with the provisions  of
 16    section 40-206, Idaho Code, and for notice  purposes of that section, the pro-
 17    posed  salaries  shall be treated as if they were an override or bond election
 18    or a hearing. The highway district commissioners may be  compensated  as  fol-
 19    lows:
 20        (a)  Commissioners  of  a  countywide highway district organized under the
 21        provisions of chapter 14, title 40, Idaho Code, as  provided  in  sections
 22        40-1404 and 40-1404A, Idaho Code.
 23        (b)  Commissioners  of  a  countywide highway district organized under the
 24        provisions of chapter 17, title 40, Idaho Code, a  salary  not  to  exceed
 25        nine  hundred  dollars  ($900) per calendar month for each member with the
 26        exception of the president or chairman of the  highway  commissioners  who
 27        may receive one thousand dollars ($1,000) per calendar month, provided the
 28        population of the county exceeds fifty thousand (50,000).
 29        (c)  Commissioners  of  all  other highway districts, a salary of seventy-
 30        five dollars ($75.00) for each day in the actual  performance  of  duties,
 31        but  the  total amount to be received as compensation shall not exceed the
 32        sum of six thousand dollars ($6,000) per year.
 33        (2)  Actual expenses shall be paid in addition to their compensation.  The
 34    payment for expenses shall be paid from the funds of the highway district upon
 35    the  presentation  of itemized vouchers, signed by the commissioners and under
 36    oath made to the secretary of the district.
 37        (3)  When a commissioner is an officer and/or agent of the  district,  the
 38    two  (2)  remaining  commissioners may fix the compensation to be paid him for
 39    his services as an officer and/or agent. A commissioner acting as  an  officer
 40    and/or  agent  of  the  district shall be entitled to his necessary and actual
 41    expenses in addition to his salary, but shall not be entitled to draw  compen-
 42    sation  as  a  commissioner when placed upon a salary. The board shall fix the
 43    compensation to be paid to the other officers and agents and employees of  the

  1    highway district, to be paid out of the treasury of the highway district.
  2        (4)  Commissioners  are considered employees of the district. The district
  3    shall be liable and responsible for the actions of  the  commissioners,  offi-
  4    cers,  agents  and/or  employees of the district when the commissioners, offi-
  5    cers, agents and/or employees are performing their duties  on  behalf  of  the
  6    district.

Statement of Purpose / Fiscal Impact


                     STATEMENT OF PURPOSE
                          RS 11965

This legislation amends Idaho Code Section 40-1314, to allow for 
the establishment of highway district commissioner salaries through 
the public budget process. The process identified in this 
legislation is similar to the procedures counties use to establish 
elected official salaries.

                          FISCAL IMPACT

None to the General Fund.
