  2    RELATING TO TEACHERS; AMENDING SECTION 33-1205, IDAHO CODE,  TO  INCREASE  THE
  3        NONREFUNDABLE  FEE FOR AN ORIGINAL CERTIFICATE OR RENEWAL OF A CERTIFICATE
  4        FROM THIRTY-FIVE DOLLARS TO FIFTY-FIVE DOLLARS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 33-1205, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        33-1205.  CERTIFICATE RECORDS AND FEES. The state board of education shall
  9    cause  to  be  maintained  a record of all certificates issued, showing names,
 10    dates of issue and renewal, and if revoked, the date thereof  and  the  reason
 11    therefor.   A thirtyfifty-five dollar ($355.00) nonrefundable fee shall accom-
 12    pany each application for an original certificate  and  each  application  for
 13    renewal.  A  fifteen  dollar  ($15.00)  nonrefundable fee shall accompany each
 14    application for certificate changes that are processed subsequent to the issu-
 15    ance of the original or renewed certificate. The fee shall be used by the pro-
 16    fessional standards commission for payment of the reasonable expenses in  per-
 17    forming its duties and responsibilities as approved by the state board of edu-
 18    cation and a portion of the fees shall be used by the state department of edu-
 19    cation to partially defray the cost of the office of certification.

Statement of Purpose / Fiscal Impact


                            STATEMENT OF PURPOSE

This legislation amends Section 33-1205 to increase the fee paid 
for initial and renewal certification required to hold professional 
positions in Idaho public schools. The operation of the Professional 
Standards Commission and the office of teacher certification will 
become more self-supporting as general fund revenues are reduced. 
The amendment increases the fee from $35 every five years to $55 
every five years, or an increase from $7 to $11 a year. The last 
increase was in 1987, when the fee changed from $4 a year to $7. In 
1981 the fee was increased from $2 to $4. And, in 1969 the fee was 
increased from $1 to $2 per year, a portion of which was dedicated 
to support the Professional Standards Commission (PSC), which began 
at that time. In 1981 the Legislature established a policy that the 
PSC would be entirely supported by the fees and a portion of the 
operational cost of the teacher certification office of the 
department of education is also to be supported by the fees. The 
proportion of operation of the certification office supported by 
fees will need to increase due to decreases in support from general 
fund revenues, and the support for the PSC from fees will also need 
to increase due to the end of private grant support in
FY2003. The grant has supported research and development functions 
of the PSC for the last 4 years, at the direction of the State Board 
of Education. The PSC has been unable to accomplish the tasks 
desired by the State Board because of a lack of the necessary 
resources.

                               Fiscal Impact
                                      
There is no increase in the expenditure of state general funds as a 
result of this amendment. The increase in fees will allow continued 
operation of the office of teacher certification without a reduction 
in services as general fund support is reduced. The fee increase 
has the potential to generate funds to accomplish some tasks within 
the responsibility of the PSC now supported by a grant from a 
private foundation to pay for a separate operation under the State
Board called Idaho s MOST (Maximizing Opportunities for Students 
and Teachers).
