SENATE BILL NO. 1399

1 AN ACT
2 RELATING TO HIGHWAYS AND BRIDGES; AMENDING SECTION 40-106, IDAHO CODE, TO
3 REVISE THE DEFINITION OF "EXPENDITURE."
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 40-106, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 40-106. DEFINITIONS -- E. (1) "Erect" means to construct, build, raise,
8 assemble, place, affix, create, paint, draw or in any other way bring into
9 being or establish, but does not include any of the foregoing activities when
10 performed incident to the change of an advertising message or customary main-
11 tenance of a sign. With respect to certain easements held by the state
12 restricting the erection of structures on certain lands, the state of Idaho
13 and the department shall be deemed to have waived such restrictions with
14 regard only to each sign erected prior to October 22, 1965.
15 (2) "Expenditure" means the awarding of a contract, franchise or author-
16 ity to another by a district, and every manner and means whereby the highway
17 district disburses district funds or obligates itself to disburse district
18 funds. "Expenditure" does not include disbursement of district funds to regu-
19 larly employed highway district employees, officials or agents, or for the
20 performance of personal services to the district, or for the acquisition of
21 personal property through a contract that has been competitively bid by the
22 state of Idaho, one of its subdivisions, or an agency of the federal govern-
23 ment.
24 (3) "Expense of the public" means the expenditure of funds for roadway
25 maintenance by any governmental agency, including funds expended by any agency
26 of the federal government, so long as the agency allows public access over the
27 roadway on which the funds were expended and such roadway is not located on
28 federal or state-owned land.
STATEMENT OF PURPOSE
RS 11958
Grants to highway district the right already given to cities and
counties to exclude personal service contracts from the definition
of “expenditure”. Will allow highway districts the ability to enter
into personal service contracts based upon competence and
qualifications rather than lowest bid. A savings to the taxpayers
of Ada County.
