  1                                        AN ACT
  2    DIRECTING THE STATE CONTROLLER TO TRANSFER CERTAIN FUNDS; DIRECTING THE SUPER-
  3        INTENDENT OF PUBLIC INSTRUCTION TO MAKE A ONE-TIME DISTRIBUTION OF  FUNDS;
  4        AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  The State Controller shall transfer $5,000,000 from the Budget
  7    Stabilization Fund to the Public Education Stabilization Fund by no later than
  8    June 30, 2005.
                                                                        
  9        SECTION  2.  Of the moneys appropriated in Section 3, Chapter 342, Laws of
 10    2004, the Superintendent of Public Instruction shall make a one-time distribu-
 11    tion of moneys to school districts that receive a reduction of state funds  as
 12    a  result  of  the  implementation of Section 33-1002C(3), Idaho Code, for the
 13    period July 1, 2004, through June 30, 2005, in a like amount as the  reduction
 14    received.
                                                                        
 15        SECTION  3.  An  emergency  existing  therefor,  which emergency is hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

Statement of Purpose

The purpose of this legislation is to ensure that Public Schools receive the level of funding,
on a per classroom basis, that was expected when the current year’s Public Schools budget was set
by the 2004 Legislature. Since this budget was set, student enrollment has surged beyond the
projections upon which the budget was based. As a result, less money is available per classroom
than was assumed when school districts built their budgets for this year. This $5 million infusion,
when added to the $7.15 million already in the Public Education Stabilization Fund, should ensure
that sufficient funds exist to cover the total shortfall, currently estimated at approximately
$10 million.

In addition, Section 2 of the bill ensures that no school district will receive an unexpected
reduction in funding as a result of changes made in SB 1221.
