                      BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE
                                                                        
  1                                        AN ACT
  2    RELATING TO THE SMALL LAWSUIT RESOLUTION ACT; AMENDING SECTION 2, CHAPTER 137,
  3        LAWS OF 2002, TO REMOVE A SUNSET CLAUSE; AND DECLARING AN EMERGENCY.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 2, Chapter 137, Laws of 2002, be, and the same is
  6    hereby amended to read as follows:
                                                                        
  7        SECTION 2. This act shall be in full force and effect on and after January
  8    1, 2003, and shall apply to all cases for which initial complaints  are  filed
  9    on  or after January 1, 2003. This act shall be null, void and of no force and
 10    effect on and after June 30, 2006, provided, however, that the  provisions  of
 11    the  act shall continue to apply to all applicable cases in which initial com-
 12    plaints are filed on or before June 30, 2006.
                                                                        
 13        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 14    declared to exist, this act shall be in full force and effect on and after its
 15    passage and approval.

                       STATEMENT OF PURPOSE

                             RS 15436

This legislation deletes the sunset clause from the Small Lawsuit
Resolution Act.  This Act was to become effective on January 1,
2003 and terminate on June 30, 2006.  With this legislation it
will continue in effect.

No fiscal impact.
