  2    RELATING TO OPTOMETRISTS; AMENDING SECTION  54-1506,  IDAHO  CODE,  TO  REVISE
  3        DESCRIPTIVE  LANGUAGE, TO PROVIDE FOR THE DEPOSIT AND DISTRIBUTION OF FEES
  4        AND TO INCREASE THE ANNUAL FEE  FOR  LICENSE  RENEWAL;  REPEALING  SECTION
  5        54-1507,  IDAHO  CODE,  RELATING  TO ADDITIONAL LICENSE FEES; AND AMENDING
  6        SECTION 54-1508, IDAHO CODE, TO REMOVE LANGUAGE REFERENCING THE  COMPENSA-
  7        TION OF BOARD MEMBERS FROM CERTAIN MONEYS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section 54-1506, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        54-1506.  STATE BOARD OF OPTOMETRY FUND -- CREATION LICENSE FEES. (1)  All
 12    fees  of any kind collected under the provisions of this act and all fees col-
 13    lected from optometrists in or out of the state of Idaho by law, except  those
 14    fees  required  by  subsection  (2) of this section and section 54-1523, Idaho
 15    Code, shall be deposited in the state treasury to the  credit  of  a  separate
 16    fund  to  be  known  as  the state board of optometry fund and all such moneys
 17    deposited into such fund are hereby appropriated to carrying out  the  purpose
 18    and objects of this act and to pay salaries, fees, costs and expenses incurred
 19    in  connection  with  the purpose and objects of this act. The funds collected
 20    shall remain perpetually in the state board of optometry fund from  one  bien-
 21    nium  to  the  next. The moneys and funds in the state board of optometry fund
 22    shall be paid out upon warrants drawn by the state controller  upon  presenta-
 23    tion of proper vouchers approved by the state board of optometry or its execu-
 24    tive  secretary  acting  within his delegated authority. Moneys paid from this
 25    fund are expressly exempted  from  the  provisions  of  sections  67-2007  and
 26    67-2008,  Idaho  Code  (Standard Travel Pay and Allowance Act of 1949) chapter
 27    shall be paid to the bureau of occupational  licenses  and  deposited  in  the
 28    state  treasury  to the credit of the occupational licenses fund and all costs
 29    and expenses incurred under the provisions of this chapter shall be  a  charge
 30    against and paid from said fund.
 31        (2)  The annual fee for renewal of a license shall be established by board
 32    rule,  not to exceed one hundred seventy-five dollars ($10075), which shall be
 33    paid to the bureau of occupational licenses, and to pay salaries, fees,  costs
 34    and expenses incurred in connection with the purposes and objects of this act.
                                                                        
 35        SECTION  2.  That  Section 54-1507, Idaho Code, be, and the same is hereby
 36    repealed.
                                                                        
 37        SECTION 3.  That Section 54-1508, Idaho Code, be, and the same  is  hereby
 38    amended to read as follows:
                                                                        
 39        54-1508.  STATE   BOARD  OF  OPTOMETRY  --  ORGANIZATION  --  MEETINGS  --
 40    EXPENSES. The board of optometry shall meet on or before September 15 of  each

  1    year and select from its members a chairman and a secretary who shall serve at
  2    the  pleasure  of the board. The secretary shall keep the minutes of the meet-
  3    ings of the board, maintain the files and records of  the  board,  maintain  a
  4    roster of all persons licensed as optometrists under this act and on or before
  5    October  1 of each year, forward to the bureau of occupational licenses a cer-
  6    tified list of those persons who have paid the fees required by this act.
  7        The board of optometry may meet at stated times and places and shall  meet
  8    upon  the  call  of  its chairman or upon written request of a majority of its
  9    members. Three (3) members shall constitute a quorum and  a  majority  of  the
 10    members  present at a meeting at which a quorum is present shall determine the
 11    action of the board. Each member of the board shall be notified of any meeting
 12    called for any purpose.
 13        Out of the moneys appropriated to the bureau from fees paid under  section
 14    54-1506(2), Idaho Code, or otherwise appropriated from fees paid under section
 15    54-1506(2),  Idaho  Code,  and  deposited  in the occupational license account
 16    established by section 67-2605, Idaho Code, the members of the board of optom-
 17    etry shall be compensated as provided by section 59-509(h), Idaho Code.
 18        Out of moneys appropriated from fees paid  under  section  54-1507,  Idaho
 19    Code,  tThe members of the board of optometry shall be compensated as provided
 20    by section 59-509(h), Idaho Code, not otherwise paid from moneys  appropriated
 21    by the legislature.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                                
                            RS 15377

     Amend sections 54-1506 and 54-1508, Idaho Code, to delete
the state board of optometry fund.  Repeal section 54-1507, Idaho
Code, and incorporate the license fee into 54-1506.  The change
would allow funds to be paid directly into the account for the
Bureau of Occupational Licenses as requested by the Idaho State
Treasurers office as are the other boards administered under the
Bureau.

     These amendments would provide that all fees received by the
Board would be deposited into one account.  This is not an
increase in fees or the cap.


                          FISCAL NOTE

     There is no fiscal impact on general funds.  There would be
a benefit to dedicated funds by eliminating fees for transferring
amounts from the special account to the bureau account.  The
benefit to the boards dedicated fund would be approximately
$2000.00 per year.
