ELECTRIC GENERATION PLANT - COUNTIES - Amends existing law to authorize
counties to establish, create, develop, acquire, own, maintain and operate
or contract for the ownership, operation and maintenance of certain
electrical generation plants not to exceed twenty-five megawatts in
capacity which use as a fuel source landfill gas, wood waste or other
biomass fuels; and to provide that all the electricity produced from the

  1                                        AN ACT
  2    RELATING TO DEVELOPMENT  OF  ENERGY  SYSTEMS  BY  COUNTIES;  AMENDING  SECTION
  3        31-869,  IDAHO  CODE, TO AUTHORIZE COUNTIES TO ESTABLISH, CREATE, DEVELOP,
  4        ACQUIRE, OWN, MAINTAIN AND OPERATE OR CONTRACT FOR THE  OWNERSHIP,  OPERA-
  5        TION  AND  MAINTENANCE  OF   CERTAIN  ELECTRICAL  GENERATION PLANTS NOT TO
  6        EXCEED TWENTY-FIVE  MEGAWATTS IN CAPACITY WHICH USE AS A FUEL SOURCE LAND-
  7        FILL GAS, WOOD WASTE OR OTHER BIOMASS FUELS, TO PROVIDE THAT ALL THE ELEC-
  8        TRICITY PRODUCED FROM THE ELECTRICAL GENERATION FACILITY SHALL BE SOLD  BY
  9        THE COUNTY AT WHOLESALE AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  That  Section  31-869, Idaho Code, be, and the same is hereby
 12    amended to read as follows:
                                                                        
 13        31-869.  DEVELOPMENT  OF   ENERGY   SYSTEMS.   The   boards   of   Ccounty
 14    Ccommissioners  of  their respective counties are empowered to establish, cre-
 15    ate, develop, own, maintain and operate or contract for the ownership,  opera-
 16    tion and maintenance of energy facilities as follows:
 17        (1)  Ggeothermal  energy systems for heating for the benefit of the county
 18    and the residents of the county.
 19        (2)  Electrical generation plants not to exceed twenty-five (25) megawatts
 20    in capacity which use as a fuel source  landfill  gas,  wood  waste  or  other
 21    biomass  fuels.  All  the  electricity produced from the electrical generation
 22    facility shall be sold by the county at wholesale.

                      STATEMENT OF PURPOSE

The purposes of this legislation is to amend Idaho Code  31-869
to authorize the Boards of County Commissioners and their
respective counties to develop, own and operate, or contract for
the ownership, operation and maintenance of, electrical
generation facilities up to 25 megawatts in capacity which use as
a fuel source landfill gas, wood waste or other biomass fuels. 

The need for this legislation is demonstrated by the recent
proposal to establish a electrical generation facility in Adams
County to utilized waste wood from the landfill and wood chips
from thinning for forest health in the surrounding forest.


                          FISCAL NOTE
                                
Enactment of this legislation could have a positive impact upon
county funds and have a neutral impact on the state's general
fund.
