  2    RELATING TO AUTOPSIES; AMENDING CHAPTER 2, TITLE 39, IDAHO CODE, BY THE  ADDI-
  3        TION  OF A NEW SECTION 39-277, IDAHO CODE, TO REQUIRE AUTOPSIES TO BE PER-
  4        FORMED IN CERTAIN CASES IN WHICH CREUTZFELDT-JAKOB  DISEASE  IS  SUSPECTED
  5        AND  TO  REQUIRE  THAT  THE  FINDINGS OF SUCH AUTOPSIES BE REPORTED TO THE
  6        DEPARTMENT OF HEALTH AND WELFARE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 2, Title 39, Idaho Code,  be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 39-277, Idaho Code, and to read as follows:
                                                                        
 11        39-277.  AUTOPSIES  FOR  SUSPECTED  CREUTZFELDT-JAKOB  DISEASE.  When   an
 12    attending  physician  or hospital has reported to the department of health and
 13    welfare that Creutzfeldt-Jakob disease (CJD) or variant CJD  is  suspected  in
 14    relation to a person's death, the state epidemiologist, as designated pursuant
 15    to  department  rule,  or  the coroner in the county in which the person died,
 16    shall cause to be performed an autopsy of  the  body,  provided  a  definitive
 17    diagnosis  has not been made prior to death and provided further that the per-
 18    son or persons having the highest authority under the  provisions  of  section
 19    54-1142, Idaho Code, do not refuse the performance of such autopsy. The person
 20    or  entity performing the autopsy shall report the findings of such autopsy to
 21    the department of health and welfare.

  1                               AMENDMENTS TO SECTION 1
  2        On page 1 of the printed bill, delete line 15 and insert:  "to  department
  3    rule,"; in line 19, delete "The person" and delete lines 20 and 21 and insert:
  4    "The  state  epidemiologist,  in ordering an autopsy pursuant to this section,
  5    shall require the person or entity performing the autopsy to report the  find-
  6    ings of such autopsy to the department of health and welfare.".

                      STATEMENT OF PURPOSE

                             RS 16104

This legislation proposes adding a new section to Chapter 2 of
Title 39 of the Idaho Code to require that the state
epidemiologist cause an autopsy to be performed in cases in which
Creuzfeldt-Jacob disease is suspected, and to require that the
findings of such autopsies be reported to the Department of
Health and Welfare.



                           FISCAL NOTE

The cost of the autopsy and related transportation cost will be
paid for by the Center for Disease Control and can be done
through Case Western University.
