  1                                        AN ACT
  2    RELATING TO QUALIFICATION OF VOLUNTEERS; AMENDING SECTION 67-2336, IDAHO CODE,
  3        TO PROVIDE THAT A PERSON MAY NOT BE REJECTED AS A VOLUNTEER FOR A STATE OR
  4        LOCAL GOVERNMENTAL ENTITY EXCEPT FOR PROVEN MISCONDUCT OR FOR  BEING  CON-
  5        VICTED  OR  FOUND  GUILTY OF A CRIMINAL OFFENSE IN THIS STATE, IN  ANOTHER
  6        STATE, TERRITORY OR PROVINCE OR BY THE FEDERAL GOVERNMENT.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 67-2336, Idaho Code, be, and the same  is  hereby
  9    amended to read as follows:
                                                                        
 10        67-2336.  QUALIFICATIONS OF VOLUNTEERS. Civil service law and requirements
 11    shall  not  apply  to  volunteers in any program conducted or sponsored by any
 12    agency, department or unit of state government.  Requirements  for  volunteers
 13    are limited to requirements set by federal statute and to any requirements set
 14    by  the  agency, department or unit of state government sponsoring the program
 15    or service. A person may not be rejected as a volunteer except for proven mis-
 16    conduct or for being convicted or found guilty of a criminal offense  in  this
 17    state, in  another state, territory or province or by the federal government.

                       STATEMENT OF PURPOSE

                             RS 15626

This bill provides that a person may not be rejected as a
volunteer for a state or local governmental entity except for the
following exceptions: proven misconduct; convicted or found
guilty of a criminal offense in this state, in another state,
territory or province or by the federal government.
