1 AN ACT
2 RELATING TO CASUALTY INSURANCE CONTRACTS; AMENDING SECTION 41-2515, IDAHO
3 CODE, TO LOWER THE ELIGIBILITY AGE FOR CERTAIN AUTOMOBILE INSURANCE POLICY
4 DISCOUNTS.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 41-2515, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 41-2515. DISCOUNT FOR CERTAIN AGE GROUPS. (1) Any insurer offering for
9 sale an automobile insurance policy, as policy is defined in subsection (a) of
10 section 41-2506, Idaho Code, in which there is insured a principal operator
11 who is sixtyfifty-five (655) years of age or older, shall provide for an
12 appropriate reduction in premium charges for liability, medical payments and
13 collision coverages if the principal operator sixtyfifty-five (655) years of
14 age or older has successfully completed a motor vehicle accident prevention
15 course which meets criteria established by the transportation department. Any
16 discount used by an insurer shall be presumed appropriate unless credible evi-
17 dence data demonstrates otherwise.
18 (2) Upon successful completion of an approved motor vehicle accident pre-
19 vention course, each participant shall be issued, by the course's sponsoring
20 entity, a certificate of completion which shall be the basis of the qualifica-
21 tion for the discount on the automobile insurance.
22 (3) The premium reduction required in this section shall be effective for
23 an insured for a three (3) year period after successful completion of the
24 approved course, except that the insurer may require, as a condition of pro-
25 viding and maintaining the discount, that the insured for a three (3) year
26 period after course completion, not be involved in an accident for which the
27 insured is at fault or be found guilty of a moving traffic violation.
28 (4) The provisions of this section shall not apply in the event the
29 approved course is specified by a court or other governmental entity resulting
30 from a moving traffic violation.
31 (5) Each participant shall take an approved course every three (3) years
32 to continue to be eligible for the reduction in premiums.
33 (6) Nothing in the provisions of this section shall be deemed to prohibit
34 an insurer from canceling or not renewing an automobile insurance policy for
35 grounds enumerated in section 41-2507, Idaho Code, or in chapter 25, title 41,
36 Idaho Code.
37 (7) The provisions of this section shall not apply in the event that such
38 an insurer offers a premium reduction which is substantially comparable to the
39 premium reduction required in this section and in no event shall such insurer
40 be required to provide both comparable premium reductions on a cumulative
41 basis.

insurance premium discounts, from 65 years to 55 years.
