                                       AN ACT
STATING FINDINGS OF THE LEGISLATURE; AND PROVIDING THAT THE STATE CONTROLLER
SHALL TRANSFER MONEYS TO THE STATE TAX COMMISSION; AND DECLARING AN EMER-
       GENCY.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. It is the finding of the Legislature that, given the improved
economic conditions that have produced state revenues in excess of projec-
tions, and given the recent unprecedented increase in gasoline prices facing
Idaho motorists, it is in the best interest of the motoring citizens of the
state of Idaho to provide temporary relief from certain motor fuel taxes. The
appropriation contained in this act will provide relief for much of Idaho's
citizenry through a temporary moratorium on certain motor fuel taxes.

SECTION 2. There is hereby appropriated and the State Controller shall
transfer on April 3, 2006, the sum of $34,806,800 from the General Fund to the
State Tax Commission for distribution pursuant to section 63-2412, Idaho Code.
In addition, there is hereby appropriated and the State Controller shall
transfer on April 3, 2006, the sum of $14,158,000 from the General Fund to the
State Tax Commission for distribution pursuant to section 63-2418, Idaho Code.

SECTION 3. An emergency existing therefor, which emergency is hereby
declared to exist, this act shall be in full force and effect on and after its
   passage and approval.
