  1                                        AN ACT
  2    RELATING TO SURVEYS; AMENDING SECTION 55-1904, IDAHO CODE, TO  REQUIRE  FILING
  3        OF A RECORD OF SURVEY WHICH RESULTS IN THE SETTING OF CERTAIN MONUMENTS AT
  4        CORNERS OF RECORD WITHIN A SPECIFIED TIME PERIOD.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 55-1904, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        55-1904.  RECORDS OF SURVEY -- WHEN FILING REQUIRED. After making a survey
  9    in conformity with established principles of land surveying, a surveyor  shall
 10    file  a  record  of  survey with the county recorder in the county or counties
 11    wherein the lands surveyed are situated. A record of  survey  shall  be  filed
 12    within ninety (90) days after completing any survey which:
 13        (1)  Discloses a material discrepancy with previous surveys of record;
 14        (2)  Establishes  boundary lines and/or corners not previously existing or
 15    of record;
 16        (3)  Results in the setting of monuments at corners of record  which  were
 17    not previously monumented; or
 18        (4)  Produces  evidence  or  information which varies from, or is not con-
 19    tained in, surveys of record relating to the public land survey,  lost  public
 20    land corners or obliterated land survey corners.

                      STATEMENT OF PURPOSE
                                
                            RS 15379

     This legislation would require that a land surveyor file a
record of survey whenever a corner of record is monumented which
has not previously been monumented.




                          FISCAL NOTE

     There is no impact on the General Fund of the State or
Dedicated Fund of the agency.  There will be a minimal additional
cost to those whose property is surveyed to file a record of
survey.
