2 RELATING TO DISTRICT HEALTH BOARDS OF TRUSTEES; AMENDING SECTION 39-411, IDAHO
3 CODE, TO PROVIDE MINIMUM AND MAXIMUM NUMBER OF MEMBERS FOR BOARDS OF
4 TRUSTEES FOR DISTRICT BOARDS OF HEALTH AND TO REVISE TERMS OF OFFICE FOR
5 ORGANIZATION PURPOSES.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 39-411, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 39-411. COMPOSITION OF DISTRICT BOARD -- QUALIFICATIONS OF MEMBERS --
10 APPOINTMENT AND REMOVAL -- TERMS -- TRUSTEE SELECTED FOR BOARD OF TRUSTEES OF
11 DISTRICT BOARDS OF HEALTH. For those districts comprised of less than eight
12 (8) counties, the district board of health shall consist of not less than
13 seven (7) or more than nine (9) members to be appointed by the boards of
14 county commissioners within each district acting jointly, and each board of
15 county commissioners may appoint a board member. For those districts comprised
16 of eight (8) counties, the district board of health shall consist of not less
17 than eight (8) or more than ten (10) members and each board of county commis-
18 sioners may appoint a board member. Each member of the district board of
19 health shall be a citizen of the United States, a resident of the state of
20 Idaho and the public health district for one (1) year immediately last past,
21 and a qualified elector. One (1) member of the district board, if available to
22 serve, shall be a physician licensed by the Idaho state board of medicine and
23 no more than one (1) member shall be appointed from any professional or spe-
24 cial interest group. All members shall be chosen with due regard to their
25 knowledge and interest in public health and in promoting the health of the
26 citizens of the state and the public health district. Representation shall be
27 assured from rural as well as urban population groups. All appointments to the
28 district board shall be confirmed by a majority vote of all the county commis-
29 sioners of all the counties located within the public health district. Any
30 member of the district board may be removed by majority vote of all the county
31 commissioners of all the counties located within the district. The members of
32 the district board, each year, shall select a chairman, a vice-chairman and a
33 trustee. The trustee shall represent the district board as a member of the
34 board of trustees of the Idaho district boards of health. The board of
35 trustees of the Idaho district boards of health shall have authority to allo-
36 cate appropriations from the legislature to the health districts. The board of
37 trustees shall develop and administer a formula for the allocation of legisla-
38 tive appropriations.
39 The members of the district board of health shall be appointed for the
40 purpose of organization as follows: One Two (12) members to be appointed for
41 a term of one (1) year, one two (12) for two (2) years, one two (12) for three
42 (3) years, two (2) for four (4) years and two (2) for five (5) years for those
43 districts comprised of eight (8) counties. For those districts composed of

1 less than seven (7) counties, the members of the district board of health
2 shall be appointed for the purpose of organization as follows: One (1) member
3 to be appointed for a term of one (1) year, two (2) for two (2) years, two (2)
4 for three (3) years and two (2) for four (4) years and two (2) for five (5)
5 years. Each succeeding vacancy shall be filled by the boards of county commis-
6 sioners within the district acting jointly and with confirmation as herein
7 described for a term of five (5) years, subject to reappointment; and vacan-
8 cies on the board for an unexpired term shall be filled for the balance of the
9 unexpired term.

This legislation allows counties to expand the District Health
Boards to accommodate the provision of medical professionals on
the boards.
