  1                                        AN ACT
  2    RELATING TO THE COMMISSION ON AGING; AMENDING SECTION 67-5008, IDAHO CODE,  TO
  3        INCLUDE  THE OMBUDSMAN PROGRAM AS ONE FOR WHICH GRANTS OR CONTRACTS MAY BE
  4        UTILIZED.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 67-5008, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        67-5008.  PROGRAMS  FOR OLDER PERSONS. The commission shall upon reviewing
  9    recommendations from local area councils on aging, as required  by  the  Older
 10    Americans  Act of 1965, as amended, allocate to local designated area agencies
 11    grants or contracts for the following purposes:
 12        (1)  Transportation -- For operating expenses only.
 13        (2)  Congregate meals -- For direct costs to  provide  nutritionally  bal-
 14    anced meals to older persons at congregate meal sites.
 15        (3)  In-home   services  --  For  direct  provision  of  case  management,
 16    homemaker, chore, telephone reassurance, home delivered meals, friendly visit-
 17    ing, shopping assistance, in-home respite and other in-home services to  older
 18    persons  living  in noninstitutional circumstances. Fees for specific services
 19    shall be based upon a variable schedule, according to rules established by the
 20    Idaho commission on aging, based upon ability to pay for such services.
 21        (4)  Adult day care -- For direct services  to  older  persons  and  their
 22    caregivers.
 23        (5)  Ombudsman -- For provision of ombudsman services as described in sec-
 24    tion 67-5009, Idaho Code.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                                
                            RS 15356

     This legislation modifies Section 67-5008, Idaho Code, to
include the Ombudsman program as one for which Idaho Senior
Services Act Funding may be utilized.  Idaho is experiencing
significant growth in the number of assisted living facilities
located in the state.  Idaho's Substate Ombudsmen are required to
visit each assisted living facility at least once every quarter. 
The growth is putting a substantial burden on local Substate
Ombudsmen as they attempt to fulfill their visitation obligation
and respond to the increasing number of resident complaints. 
Idaho's Ombudsman program currently receives only federal
funding, as the Idaho Senior Services Act does not include the
Ombudsman program as one of which state funding may be utilized. 
We propose modifying the statute to include the Ombudsman program
to afford the Area Agencies on Aging more flexibility in funding
their Ombudsman and other Senior Services Act programs.



                          FISCAL NOTE

     None at this time.  The Ombudsman program will share in the
total funds allocated to Senior Services Act programs.
