  1                                        AN ACT
  2    RELATING TO A DRUG HOTLINE FEE; AMENDING CHAPTER 27, TITLE 37, IDAHO CODE,  BY
  3        THE  ADDITION OF A NEW SECTION 37-2735A, IDAHO CODE, TO PROVIDE FOR A DRUG
  4        HOTLINE FEE FOR DRUG VIOLATIONS; AND AMENDING SECTION 57-816, IDAHO  CODE,
  5        TO  PROVIDE  CORRECT  TERMINOLOGY  AND  TO  PROVIDE FOR THE USE OF CERTAIN
  6        MONEYS TO SUPPORT A TWENTY-FOUR HOUR ANONYMOUS HOTLINE AND  REWARD  SYSTEM
  7        FOR THE REPORTING OF DRUG VIOLATIONS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Chapter  27,  Title 37, Idaho Code, be, and the same is
 10    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 11    ignated as Section 37-2735A, Idaho Code, and to read as follows:
                                                                        
 12        37-2735A.  DRUG  HOTLINE FEE. In addition to any other penalties, a person
 13    convicted of a violation of this chapter shall be  subject  to  an  additional
 14    fine  of ten dollars ($10.00) to be deposited in the drug enforcement donation
 15    fund, as set forth in section 57-816, Idaho Code, to be used for the  purposes
 16    designated in that section.
                                                                        
 17        SECTION  2.  That  Section  57-816, Idaho Code, be, and the same is hereby
 18    amended to read as follows:
                                                                        
 19        57-816.  DRUG ENFORCEMENT DONATION ACCOUNT FUND. (1) There is hereby  cre-
 20    ated  in  the state operating fund the drug enforcement donation account fund.
 21    Moneys in the account fund may be appropriated only for programs  designed  to
 22    control  or  eliminate illicit drug traffic, and for law enforcement functions
 23    associated with such control.
 24        (2)  Separate and apart from any other moneys in the fund,  moneys  depos-
 25    ited  in  the  fund  pursuant  to  section 37-2735A, Idaho Code, shall be used
 26    exclusively to support a twenty-four (24) hour anonymous  hotline  and  reward
 27    system, including any advertising for and about such system, for the reporting
 28    of drug violations.

                      STATEMENT OF PURPOSE

This bill expands the "marijuana hotline" managed by the Idaho State
Police to include a 24 hour hotline for reporting tips on
methanphetamine laboratories and drug dealing. It also authorizes
promotion and rewards for reporting (like "Citizen s Against
Poaching")and establishes a Drug Enforcement Donation Fund to support
these activities. In addition, a fine will be assessed to persons
convicted of a drug crime (Chapter 27, Title 37, Idaho Code) to cover
the operations.*
