  1                                        AN ACT
  2    RELATING TO MEDICAID; AMENDING CHAPTER 2, TITLE 56, IDAHO CODE, BY  THE  ADDI-
  3        TION  OF  A NEW SECTION 56-234, IDAHO CODE, TO STATE LEGISLATIVE FINDINGS,
  4        TO ESTABLISH A MEDICAID PROGRAM FOR CAREGIVERS,  TO  PROVIDE  FOR  PROGRAM
  5        CRITERIA, TO REQUIRE AN ANNUAL REPORT; AND PROVIDING A SUNSET DATE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  2,  Title  56, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 56-234, Idaho Code, and to read as follows:
                                                                        
 10        56-234.  CAREGIVER  SUPPORT. (1) The legislature finds that Idaho medicaid
 11    could avoid costs of premature  institutional  care  and  ensure  delivery  of
 12    patient-preferred  noninstitutional care. Idaho medicaid should support family
 13    caregivers who care for persons at risk for progression to nursing home levels
 14    of care.
 15        (2)  The director of the department of health and welfare shall:
 16        (a)  Establish a medicaid program  for  caregivers  of  persons  who  meet
 17        financial  eligibility criteria for medicaid and who do not currently meet
 18        criteria  for  nursing  facility  levels  of  care  but  are  at  risk  of
 19        progressing to nursing facility levels of care as demonstrated  by  appro-
 20        priate  clinical  assessment  and  whose informal caregivers have a demon-
 21        strated state of physical, emotional or mental fatigue; and
 22        (b)  Use an established scale to measure caregiver  capacity  and  vulner-
 23        ability and to determine eligibility for respite services.
 24        (3)  This  program  shall  be  made available for up to five hundred (500)
 25    persons, based on available funding.
 26        (4)  The director shall make an annual report to the legislature as to the
 27    effectiveness of the program established in this section.
                                                                        
 28        SECTION 2.  This act shall be null, void and of no force and effect on and
 29    after July 1, 2009.

                       STATEMENT OF PURPOSE

                             RS 16341

The Legislature finds that Idaho Medicaid could avoid costs of
premature nursing facility placement by establishing a Medicaid
respite care program for vulnerable caregivers of persons who
meet financial eligibility criteria for Medicaid and who are at
risk of nursing home levels of care.


                           FISCAL NOTE

This program is intended to be budget neutral within the capped
appropriation for Medicaid Nursing Facilities and the Aged and
Disabled Waiver, and further controlled through a limit on the
number of persons who can enroll in the program.
