GOVERNMENTAL MEETINGS - Amends existing law to provide that a full
transcript of a meeting of a state or local unit of government is not
required except as otherwise provided by law; to provide that a recording
of the meeting is required; to provide that all recordings shall be
retained for a minimum of seven years from the date of the meeting; and to
provide that such recordings shall be deemed a public record pursuant to
the Public Records Act.

2 RELATING TO MINUTES OF GOVERNMENTAL MEETINGS; AMENDING SECTION 67-2344, IDAHO
3 CODE, TO PROVIDE THAT A FULL TRANSCRIPT OF A MEETING IS NOT REQUIRED
4 EXCEPT AS OTHERWISE PROVIDED BY LAW AND TO PROVIDE THAT A RECORDING OF THE
5 MEETING IS REQUIRED AND ALL RECORDINGS SHALL BE RETAINED FOR A MINIMUM OF
6 SEVEN YEARS FROM THE DATE OF THE MEETING AND SUCH RECORDINGS SHALL BE
7 DEEMED A PUBLIC RECORD PURSUANT TO THE PUBLIC RECORDS ACT AND TO MAKE A
8 TECHNICAL CORRECTION.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 67-2344, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 67-2344. WRITTEN MINUTES OF MEETINGS. (1) The governing body of a public
13 agency shall provide for the taking of written minutes of all its meetings.
14 Neither a A full transcript nor a recording of the meeting is not required,
15 except as otherwise provided by law. A recording of the meeting is required
16 and all recordings shall be retained for a minimum of seven (7) years from the
17 date of the meeting and such recordings shall be deemed a public record pursu-
18 ant to chapter 3, title 9, Idaho Code. All minutes shall be available to the
19 public within a reasonable time after the meeting, and shall include at least
20 the following information:
21 (a) All members of the governing body present;
22 (b) All motions, resolutions, orders, or ordinances proposed and their
23 disposition;
24 (c) The results of all votes, and upon the request of a member, the vote
25 of each member, by name;.
26 (2) Minutes of executive sessions may be limited to material the disclo-
27 sure of which is not inconsistent with the provisions of section 67-2345,
28 Idaho Code, but shall contain sufficient detail to convey the general tenor of
29 the meeting.
STATEMENT OF PURPOSE
RS 15616
This bill would provide that recordings of meetings be required
and retained for seven years and such recordings be deemed a
public record. A full transcript of the meeting is not required,
except as otherwise provided by law.
