  1                                        AN ACT
  2    RELATING TO THE OPERATION OF RAILROADS; AMENDING CHAPTER 4,  TITLE  62,  IDAHO
  3        CODE,  BY  THE  ADDITION OF A NEW SECTION 62-425, IDAHO CODE, TO PROVIDE A
  4        MINIMUM DISTANCE FOR TRAINS STANDING NEAR CROSSINGS WITH TWO OR MORE ADJA-
  5        CENT TRACKS AND TO PROVIDE A PENALTY FOR EACH SUCH VIOLATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 4, Title 62, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 62-425, Idaho Code, and to read as follows:
                                                                        
 10        62-425.  PARKING OF TRAINS NEAR CROSSINGS. Whenever a  railroad  with  two
 11    (2)  or  more  adjacent  tracks crosses any public street, road or highway, no
 12    part of a train's cars, engines or equipment shall stand  less than five  hun-
 13    dred  (500) feet from the crossing. Each violation of this section shall incur
 14    a penalty of one hundred dollars ($100) to be paid by the corporation  operat-
 15    ing  the  railroad  and  which may be recovered in an action prosecuted by the
 16    prosecuting attorney of the proper county for the use of the state.

                       STATEMENT OF PURPOSE

                             RS 15839

Relating to the operation of railroads amending Chapter 4, Title
62 creating a New Section 62-425 to provide a minimum distance
for trains. Standing near crossings with two or more adjacent
tracks and to provide a penalty for each such violation.
