1 AN ACT
2 RELATING TO MEDICAID REIMBURSEMENT; AMENDING THE HEADING FOR PART E, CHAPTER
3 1, TITLE 56, IDAHO CODE; AMENDING SECTION 56-136, IDAHO CODE, TO REMOVE A
4 FISCAL YEAR BEGINNING DATE, TO ADD DENTISTS TO THE RATE OF REIMBURSEMENT
5 FOR MEDICAID COVERED SERVICES, TO PROVIDE THAT ACTUAL PAYMENTS TO A DEN-
6 TIST SHALL NOT EXCEED USUAL AND CUSTOMARY CHARGES AND TO DEFINE "DENTIST."
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That the Heading for Part E, Chapter 1, Title 56, Idaho Code,
9 be, and the same is hereby amended to read as follows:
10 PART E.
11 PHYSICIANS AND DENTISTS
12 SECTION 2. That Section 56-136, Idaho Code, be, and the same is hereby
13 amended to read as follows:
14 56-136. PHYSICIAN AND DENTIST REIMBURSEMENT. (1) Beginning with fiscal
15 year 1996, tThe rate of reimbursement for all medicaid-covered physician and
16 dentist services rendered to medicaid recipients shall be adjusted each fiscal
17 year. Each fiscal year adjustment shall be determined by the director and
18 shall equal the year over year inflation rate forecasted as of the midpoint of
19 the fiscal year by the all item, goods and services index in the pacific
20 northwest as published by data resources incorporated. Such forecast index
21 shall be the last published forecast prior to the start of the fiscal year.
22 Provided however, an adjustment may exceed the index rate cited in this sec-
23 tion at the discretion of the legislature.
24 (2) Actual payments made by the director to each physician and dentist
25 shall not exceed the usual and customary charges made to private pay patients.
26 (3) For the purposes of this section,:
27 (a) "pPhysican" means a person licensed to practice medicine pursuant to
28 chapter 18, title 54, Idaho Code.
29 (b) "Dentist" means a person licensed to practice dentistry pursuant to
30 chapter 9, title 54, Idaho Code.
31 (4) The amount to be paid under the provisions of this section shall in
32 no event exceed any limitations imposed by federal law or regulation.
STATEMENT OF PURPOSE
RS 15959
This legislation would add Dentists to Idaho Code section 56-136.
Idaho Code section 56-136 provides for an annual adjustment for
the rate of reimbursement paid to physicians for Medicaid-covered
services.
FISCAL IMPACT
Approximately $150,000 annually from the general account.
