HOUSE BILL NO. 52
BY TRANSPORTATION AND DEFENSE COMMITTEE
1 AN ACT
2 RELATING TO MILITARY RETIREMENT; AMENDING SECTION 46-206, IDAHO CODE, TO DES-
3 IGNATE WHO MAY BE PLACED ON THE RETIREMENT LIST AND TO PROVIDE FOR HONOR-
4 ARY PROMOTIONS; AND REPEALING SECTION 46-214, IDAHO CODE, RELATING TO
5 RETIREMENT OF ENLISTED PERSONNEL.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 46-206, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 46-206. RETIREMENT OF OFFICERS -- TIME OF SERVICE. Any officer of the
10 national guard who loses his federal recognition because of mandatory retire-
11 ment may be advanced one (1) grade and may be placed upon the retired list by
12 order of the governor as commander-in-chief. Upon request, aAny commissioned
13 officer, warrant officer or enlisted member of the national guard of Idaho who
14 has served as an officer in the national guard of Idaho for a period a total
15 military service in the armed forces of the United States of twenty (20)
16 years, upon his request, may be placed on the retirement list. In the discre-
17 tion of the adjutant general, any member may be advanced one (1) grade, and
18 placed upon the retired list prior to retirement. Any commissioned officer who
19 has a total service in the armed forces of the United States and in the
20 national guard of Idaho of fifteen (15) years, may upon his request be
21 advanced one (1) grade and retired Promotions under this section shall be hon-
22 orary.
23 SECTION 2. That Section 46-214, Idaho Code, be, and the same is hereby
24 repealed.
STATEMENT OF PURPOSE
RS 16660
This proposal amends Chapter 2, Title 46, by deleting Section 46-214
and amending Section 46-206, to correct out-dated language and clarify
the Adjutant General s statutory authority to provide brevet promotions
to retiring officers, warrant officers and enlisted members.

There is no fiscal impact from this proposal.
