1 AN ACT
2 RELATING TO THE NATIONAL GUARD; AMENDING SECTION 46-609, IDAHO CODE, TO PRO-
3 VIDE FOR THE ADJUTANT GENERAL TO CALL MILITARY PERSONNEL TO SPECIAL DUTY
4 WITH THEIR CONSENT AND TO PROVIDE FOR COMPENSATION OF MILITARY PERSONNEL
5 CALLED TO SPECIAL DUTY.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 46-609, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 46-609. OFFICERS AND ENLISTED PERSONNEL ON SPECIAL DUTY -- COMPENSATION
10 AND ALLOWANCES. Commissioned oOfficers and enlisted personnel of the national
11 guard may be ordered upon special duty at the direction of the adjutant gen-
12 eral, if with their consent, or at the direction of the governor as commander-
13 in-chief, with or without their consent., and if with their consent, notwith-
14 standing the provisions of sections 46-605 and 46-607, Idaho Code, such duty
15 may be without any pay or allowances, but if without consent, tThey shall
16 receive the same pay and allowances as prescribed provided in section 46-605,
17 Idaho Code, during the time they may continue upon duty under such order.

6 On page 1, in line 4, following "CONSENT" insert: "FOR UP TO A SPECIFIED
7 PERIOD OF TIME WITHOUT THE APPROVAL OF THE GOVERNOR".

STATEMENT OF PURPOSE
RS 16661
This proposal amends Chapter 6, Title 46, by amending Section 46-609,
to provide the Adjutant General statutory authority to call National
Guard members to special duty on behalf of the state, provided such
call-up is with the consent of the member.

There is no fiscal impact from this proposal.
