  1                                        AN ACT
  2    RELATING TO REFUNDING AND REPLACEMENT BONDS; REPEALING CHAPTER 37,  TITLE  67,
  3        IDAHO  CODE,  RELATING TO STATE REFUNDING BONDS; AND REPEALING CHAPTER 38,
  4        TITLE 67, IDAHO CODE, RELATING TO REPLACEMENT BONDS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Chapter 37, Title 67, Idaho Code, be,  and  the  same  is
  7    hereby repealed.
                                                                        
  8        SECTION  2.  That  Chapter  38,  Title 67, Idaho Code, be, and the same is
  9    hereby repealed.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16818

This bill repeals Idaho code Title 67, Chapter 37 and 38.  
     
Chapter 37 deals with refunding bonds and is superseded by Title
57, Chapter 5, which expressly includes the state as one of the
entities that can issue refunding bonds under that chapter.
     
The provisions of Chapter 38, Title 67, dealing with replacement
bonds is also outdated and unnecessary.  New bonds issued by the
state will be in registered, book-entry form, and the plan of
financing will have a paying agent provision attached to that
specific bond issue.
