  1                                        AN ACT
  2    RELATING TO OUT-OF-STATE MAIL SERVICE PHARMACIES;  AMENDING  SECTION  54-1747,
  3        IDAHO  CODE,  TO  REDUCE  THE NUMBER OF DAYS PER WEEK AN OUT-OF-STATE MAIL
  4        SERVICE PHARMACY MUST PROVIDE TOLL-FREE TELEPHONE SERVICE FOR PURPOSES  OF
  5        PATIENT COMMUNICATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 54-1747, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        54-1747.  PATIENT COMMUNICATION. Every out-of-state mail service  pharmacy
 10    shall,  during its regular hours of operation, but not less than six five (65)
 11    days per week, and for a minimum of forty (40) hours per week, provide a toll-
 12    free telephone service to facilitate communication between  patients  in  this
 13    state  and  a  pharmacist  at  the  pharmacy  who  has access to the patient's
 14    records. This toll-free number shall be disclosed on a label affixed  to  each
 15    container of drugs dispensed to patients in this state.

                    STATEMENT OF PURPOSE

                          RS 16471

The proposed legislation will revise Idaho Code ยง 54-1747 
changing the minimum days per week for toll-free telephone 
service to mail service pharmacies from six days to five.  Many 
mail service pharmacies do not operate six days per week, rather 
they only operate five days, and this modification dovetails 
general hours of operation into the statute.




                        FISCAL NOTE

There will be no fiscal impact from the passage of this 
legislation.
