BIRTH DEFECTS - ALCOHOL - Adds to existing law to provide for certain
warning notices relating to birth defects caused by consumption of alcohol,
spirits, wine or beer; and to provide for the designing and printing of
warning notices by the Department of Health and Welfare and the
distribution of the notices by the Alcohol Beverage Control Division of the
Idaho State Police.

2 RELATING TO BIRTH DEFECTS FROM ALCOHOL; AMENDING TITLE 23, IDAHO CODE, BY THE
3 ADDITION OF A NEW CHAPTER 15, TITLE 23, IDAHO CODE, TO PROVIDE FOR CERTAIN
4 WARNING NOTICES RELATING TO BIRTH DEFECTS CAUSED BY CONSUMPTION OF ALCO-
5 HOL, SPIRITS, WINE OR BEER, TO PROVIDE FOR THE DESIGNING AND PRINTING OF
6 THE WARNING NOTICES BY THE DEPARTMENT OF HEALTH AND WELFARE, DIVISION OF
7 BEHAVIORAL HEALTH, AND TO PROVIDE FOR THE DISTRIBUTION OF THE NOTICES BY
8 THE ALCOHOL BEVERAGE CONTROL DIVISION OF THE IDAHO STATE POLICE.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Title 23, Idaho Code, be, and the same is hereby amended
11 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap-
12 ter 15, Title 23, Idaho Code, and to read as follows:
13 CHAPTER 15
14 BIRTH DEFECTS FROM ALCOHOL
15 23-1501. BIRTH DEFECTS FROM ALCOHOL, SPIRITS, WINE OR BEER -- WARNING
16 NOTICES REQUIRED. Any liquor store, distributing station, or other store or
17 establishment that sells or serves alcohol, spirits, wine or beer within the
18 state of Idaho, shall cause to be posted conspicuously, and shall maintain
19 posted conspicuously, in at least two (2) places within each liquor store,
20 distributing station, or other store or establishment, notices in print warn-
21 ing persons that consumption of alcohol, spirits, wine or beer shortly before
22 conception or during pregnancy can cause birth defects, including fetal alco-
23 hol syndrome and fetal alcohol effects. The Idaho department of health and
24 welfare, division of behavioral health, shall design and print the warning
25 notices and provide the notices to the alcohol beverage control division of
26 the Idaho state police to be distributed in the process of license renewals
27 for liquor stores, distributing stations and other stores and establishments
28 that sell or serve alcohol, spirits, wine or beer within the state of Idaho.
29 The alcohol beverage control division of the Idaho state police shall provide
30 replacement notices upon request.

This legislation will be a public warning that consumption of
alcohol shortly before conception or during pregnancy can cause
birth defects.
