  1                                        AN ACT
  2    RELATING TO TELEPHONE CALLS; AMENDING CHAPTER 10, TITLE 48, IDAHO CODE, BY THE
  3        ADDITION OF A NEW SECTION 48-1003C, IDAHO CODE, TO PROVIDE DUTIES  WHEN  A
  4        PERSON INTENDS TO UTILIZE AN AUTOMATIC DIALING-ANNOUNCING DEVICE TO SEND A
  5        MESSAGE AND TO DEFINE TERMS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  10,  Title 48, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 48-1003C, Idaho Code, and to read as follows:
                                                                        
 10        48-1003C.  AUTOMATIC DIALING-ANNOUNCING DEVICE.
 11        (1)  When  a  person  intends  to utilize  an automatic dialing-announcing
 12    device to send a message by using or connecting to a telephone line, the  per-
 13    son must, at the outset of the message, disclose the following:
 14        (a)  The name of the person for whom the message is being made;
 15        (b)  The purpose of the message; and
 16        (c)  The contact information of the caller.
 17        (2)  As used in this section:
 18        (a)  "Automatic dialing-announcing device" means a device that selects and
 19        dials  telephone  numbers  and  that, working alone or in conjunction with
 20        other equipment, disseminates a prerecorded or synthesized  voice  message
 21        to the telephone number called.
 22        (b)  "Caller"  means a person who contacts, or attempts to contact, a sub-
 23        scriber in this state by using an automatic dialing-announcing device.
 24        (c)  "Subscriber" means a person who has subscribed to  telephone  service
 25        from  a  telephone  company,  or other persons living or residing with the
 26        subscribing person.

                       STATEMENT OF PURPOSE

                            RS 17024

This bill adds a new section to the Telephone Solicitation Act
requiring that calls placed by an automatic dialing-announcing
device (robocalls) must state at the start of the call the name
of the person for whom the call is being made, the purpose of the
call and contact information for the caller.  This will clarify
the purpose of the call in the recipient's mind and lessen
confusion.
