1 AN ACT
2 APPROPRIATING ADDITIONAL ONE-TIME MONEYS TO THE STATE BOARD OF EDUCATION FOR
3 SPECIAL PROGRAMS FOR FISCAL YEAR 2008; APPROPRIATING ADDITIONAL ONGOING
4 MONEYS TO THE STATE BOARD OF EDUCATION FOR SPECIAL PROGRAMS FOR FISCAL
5 YEAR 2008; PROVIDING FOR THE USE OF FUNDS; APPROPRIATING ADDITIONAL MONEYS
6 FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL YEAR 2008; AND
7 EXPRESSING LEGISLATIVE INTENT REGARDING USE OF FUNDS.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. In addition to any other appropriation provided by law, there
10 is hereby appropriated to the State Board of Education for Special Programs
11 for Scholarships and Grants, $10,000,000, one-time, for trustee and benefit
12 payments from the General Fund for the period July 1, 2007, through June 30,
13 2008. These moneys shall be deposited into the Opportunity Scholarship Program
14 Account as established in House Bill No. 217, as enacted by the First Regular
15 Session of the Fifty-ninth Idaho Legislature, for the purpose of creating the
16 corpus of said account. Earnings therefrom shall be distributed annually as
17 prescribed by law and subject to the conditions set forth in Section 3 of this
18 act.
19 SECTION 2. In addition to any other appropriation provided by law, there
20 is hereby appropriated to the State Board of Education for Special Programs
21 for Scholarships and Grants, $1,925,000, ongoing, for trustee and benefit pay-
22 ments from the General Fund for the period July 1, 2007, through June 30,
23 2008. These moneys shall be used for the Idaho Opportunity Scholarship subject
24 to the conditions set forth in Section 3 of this act.
25 SECTION 3. When awarding the Idaho Opportunity Scholarship, the State
26 Board of Education shall give first priority to all eligible students attend-
27 ing eligible public postsecondary institutions. Any remaining scholarship
28 funds may be made available to other eligible students attending eligible pri-
29 vate, not-for-profit, postsecondary institutions.
30 SECTION 4. In addition to any other appropriation provided by law, there
31 is hereby appropriated to the Office of the State Board of Education the fol-
32 lowing amount to be expended according to the designated expense classes from
33 the listed fund for the period July 1, 2007, through June 30, 2008:

36 Operating Expenditures 55,000
37 TOTAL $75,000

40 SECTION 5. It is legislative intent that the moneys appropriated in Sec-

1 tion 4 of this act may be used by the Office of the State Board of Education
2 for administrative costs related to the start-up and implementation of the
3 Idaho Opportunity Scholarship.
