SENATE BILL NO. 1026

1 AN ACT
2 RELATING TO EDUCATION; AMENDING SECTION 33-102, IDAHO CODE, TO PROVIDE FOR
3 TERMS OF MEMBERS APPOINTED TO THE STATE BOARD OF EDUCATION.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 33-102, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 33-102. MEMBERSHIP -- APPOINTMENT -- TERM OF OFFICE -- QUALIFICATIONS --
8 PLACE OF OFFICE. The state board of education shall consist of the state
9 superintendent of public instruction, who shall be an ex officio voting member
10 and who shall serve as executive secretary of the board for all elementary and
11 secondary school matters, and seven (7) members appointed by the governor,
12 each for a term of five (5) three (3) years. Annually on the first day of
13 March the governor shall appoint members to fill the board positions for which
14 the terms of office have expired. The governor shall, by appointment, fill any
15 vacancy on the board, such appointment to be for the unexpired term of the
16 retiring member. Appointment to the board shall be made solely upon consider-
17 ation of the ability of such appointees efficiently to serve the interests of
18 the people, and education, without reference to locality, occupation, party
19 affiliation or religion. Any person appointed to said board shall have been a
20 resident of the state for not less than three (3) years prior to the date of
21 appointment; and shall qualify and assume the duties in accordance with laws
22 governing similar appointments to, and qualifications for, office on other
23 state boards. All appointments of members to the state board of education made
24 after the effective date of this act must be confirmed by the senate.
25 Members of the state board of education holding office on the effective
26 date of this act shall continue in office for the balance of the term to which
27 they were appointed.
28 The state board shall have and maintain its office in Ada county.
STATEMENT OF PURPOSE

The purpose of this legislation is to provide that the terms of
office for members of the State Board of Education shall be three
years.
