]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1076 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO POISON CONTROL; REPEALING SECTIONS 56-1036, 56-1037, 56-1038, 3 56-1039 AND 56-1040, IDAHO CODE, RELATING TO THE PURPOSE, ESTABLISHMENT, 4 OPERATION, AUTHORITY AND DUTIES OF A STATEWIDE POISON CONTROL CENTER. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Sections 56-1036, 56-1037, 56-1038, 56-1039 and 56-1040, 7 Idaho Code, be, and the same are hereby repealed.
STATEMENT OF PURPOSE RS 16469 To repeal the Poison Control Act (Idaho Code §56-1036 through §56-1040). This law states that the Department of Health and Welfare shall “establish and support…a statewide poison control center”. This law was passed in 1996; however no appropriation accompanied the legislation. Since 1996, Idaho’s poison control center has been funded with federal Temporary Assistance to Needy Families (TANF) funds which are no longer available. Without the appropriation of state general funds to replace the federal dollars, there will be insufficient funds to maintain the poison control center. FISCAL NOTE Repealing this law will not impact state general funds as no General Funds currently support the poison control center.
