]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1144 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO CONTROLLED SUBSTANCES; AMENDING ARTICLE III, CHAPTER 27, TITLE 37, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 37-2727, IDAHO CODE, TO PRO- 4 VIDE FOR THE DISPENSATION BY NURSES OF CERTAIN CONTROLLED SUBSTANCES IN A 5 NARCOTICS TREATMENT FACILITY AND TO EXEMPT CERTAIN NURSES FROM REGISTRA- 6 TION REQUIREMENTS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Article III, Chapter 27, Title 37, Idaho Code, be, and 9 the same is hereby amended by the addition thereto of a NEW SECTION, to be 10 known and designated as Section 37-2727, Idaho Code, and to read as follows: 11 37-2727. CONTROLLED SUBSTANCES IN NARCOTIC TREATMENT PROGRAMS. (1) At a 12 facility with a controlled substance registration certificate issued by the 13 United States department of justice, drug enforcement administration, for the 14 operation of a narcotic treatment program, a nurse licensed under chapter 14, 15 title 54, Idaho Code, may, pursuant to a valid order of a physician licensed 16 under chapter 18, title 54, Idaho Code: 17 (a) Prepare and administer to a patient at that facility a controlled 18 substance whether or not a practitioner is present; and 19 (b) Deliver at that facility to a patient for subsequent use by the 20 patient off-site, take-home doses of a controlled substance, provided 21 that: 22 (i) The patient is entitled to receive take-home doses of the con- 23 trolled substance; 24 (ii) The take-home doses delivered by the nurse to the patient were 25 obtained at the facility by the nurse from a locked storage area 26 suitable to prevent unauthorized access and to ensure a proper envi- 27 ronment for preservation of the drugs within such area; and 28 (iii) The take-home doses were prepared pursuant to a valid order of 29 the physician by a pharmacist licensed under chapter 17, title 54, 30 Idaho Code, and were delivered by the pharmacist to the locked stor- 31 age area at the facility in a suitable container appropriately 32 labeled for subsequent delivery by the nurse to the patient and for 33 subsequent use by the patient entitled to receive the take-home doses 34 of the controlled substance. 35 (2) A nurse acting under the authority of this section is exempt from the 36 registration requirements imposed by this chapter.
STATEMENT OF PURPOSE RS 16933 This legislation permits nurses to administer controlled substances to patients at narcotic treatment facilities pursuant to a doctor's orders. Currently there are no narcotic treatment facilities in Idaho because the daily doses of medication may be administered only by a physician, physician s assistant or advance practice professional nurse. Not only does this require unnecessary additional cost, making these centers uneconomic, it is not ajob that requires the advanced skills those people possess. Passage of this legislation will enable narcotics treatment to be made available in Idaho. FISCAL NOTE There will be no direct fiscal impact to the general fund although to the extent treatment is available for people with narcotics addiction, demands placed on the general fund by those people should be reduced.
