HIGHWAY DISTRICTS - ELECTION - Amends existing law to provide that each
candidate for highway district commissioner in single countywide districts
with a population of two hundred thousand or less shall file a declaration
of candidacy with the county clerk not less than ninety days prior to the
general election; and to provide that each candidate for highway district
commissioner in single countywide districts with a population of more than
two hundred thousand shall file a declaration of candidacy with the county
clerk not less than ninety days prior to the general election.

  1                                        AN ACT
  2    RELATING TO ELECTION  OF  HIGHWAY  DISTRICT  COMMISSIONERS;  AMENDING  SECTION
  3        34-625,  IDAHO  CODE,  TO PROVIDE THAT EACH CANDIDATE FOR HIGHWAY DISTRICT
  4        COMMISSIONER IN SINGLE COUNTYWIDE DISTRICTS WITH A POPULATION OF TWO  HUN-
  5        DRED  THOUSAND  OR  LESS  SHALL  FILE  A DECLARATION OF CANDIDACY WITH THE
  6        COUNTY CLERK NOT LESS THAN NINETY DAYS PRIOR TO THE GENERAL ELECTION;  AND
  7        AMENDING  SECTION  34-625A, IDAHO CODE, TO PROVIDE THAT EACH CANDIDATE FOR
  8        HIGHWAY DISTRICT COMMISSIONER IN SINGLE COUNTYWIDE DISTRICTS WITH A  POPU-
  9        LATION  OF  MORE  THAN   TWO HUNDRED THOUSAND  SHALL FILE A DECLARATION OF
 10        CANDIDACY WITH THE COUNTY CLERK NOT LESS THAN NINETY  DAYS  PRIOR  TO  THE
 11        GENERAL ELECTION.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  That  Section  34-625, Idaho Code, be, and the same is hereby
 14    amended to read as follows:
                                                                        
 15        34-625.  ELECTION OF HIGHWAY DISTRICT COMMISSIONERS IN  SINGLE  COUNTYWIDE
 16    DISTRICTS  --  QUALIFICATIONS.  (1) In each general election, highway district
 17    commissioners in single countywide districts shall be elected as provided  for
 18    in section 40-1404, Idaho Code.
 19        (2)  No  person shall be elected to the office of highway district commis-
 20    sioner unless he shall have attained the age of twenty-one (21) years  at  the
 21    time  of his election, is a citizen of the United States, and shall be a resi-
 22    dent of the highway district commissioner's subdistrict  for  which  he  seeks
 23    office.
 24        (3)  Each  candidate shall file a declaration of candidacy with the county
 25    clerk not more less than ninety (90) days nor less than sixty (60) days  prior
 26    to  the  general  election.  Each declaration of candidacy shall also bear the
 27    following words: "I am a resident within the boundaries  of  Highway  District
 28    Commissioner's Subdistrict Number ....."
 29        (4)  Each candidate who files a declaration of candidacy shall at the same
 30    time  pay a filing fee of ten dollars ($10.00) which shall be deposited in the
 31    county current expense fund.
                                                                        
 32        SECTION 2.  That Section 34-625A, Idaho Code, be, and the same  is  hereby
 33    amended to read as follows:
                                                                        
 34        34-625A.  ELECTION  OF  HIGHWAY  DISTRICT  COMMISSIONERS IN CERTAIN SINGLE
 35    COUNTYWIDE DISTRICTS -- QUALIFICATIONS. (1) In each general election,  highway
 36    district commissioners in single countywide districts shall be elected as pro-
 37    vided for in section 40-1404A, Idaho Code.
 38        (2)  No  person shall be elected to the office of highway district commis-
 39    sioner unless he shall have attained the age of twenty-one (21) years  at  the
 40    time  of his election, is a citizen of the United States, and shall be a resi-

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17010

     The purpose of this bill is to require candidates for the
position of highway district commissioner to file a declaration of
candidacy at least ninety days prior to the general election.  The
reason for this requirement is to allow county clerks sufficient
time to print ballots.


                           FISCAL NOTE

     This bill has no effect on the general fund.  It will save
costs incurred by county clerks in printing and preparing ballots.
