                            SENATE CONCURRENT RESOLUTION NO. 114
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE INDUS-
  3        TRIAL COMMISSION PERTAINING TO MISCELLANEOUS PROVISIONS.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that  the Legislature finds that the rules are not consistent with legislative
  8    intent; and
  9        WHEREAS, it is the finding of the Legislature that a certain rule  of  the
 10    Industrial  Commission Rule pertaining to Miscellaneous Provisions is not con-
 11    sistent with legislative intent and should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 13    of the Fifty-ninth Idaho Legislature, the Senate and House of  Representatives
 14    concurring  therein, that, effective March 15, 2007, IDAPA 17.02.08, Miscella-
 15    neous Provisions, Section 031, relating to Acceptable Charges for Medical Ser-
 16    vices Under the Idaho Workers' Compensation Law, Subsection 02.b, only,  Rules
 17    of the Industrial Commission, as adopted as a pending rule under Docket Number
 18    17-0208-0602,  be, and the same is hereby rejected and declared null, void and
 19    of no force and effect.

                      STATEMENT OF PURPOSE

This concurrent resolution would reject a subsection of a pending
rule of the Industrial Commission pertaining to Miscellaneous
Provisions. The effect of this resolution, if adopted by both
houses, would be to prevent the agency rule from going into
effect.
