                            SENATE CONCURRENT RESOLUTION NO. 116
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE  DIVI-
  3        SION OF HUMAN RESOURCES AND PERSONNEL COMMISSION.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Division of Human Resources and Personnel Commission is  not  consistent  with
 11    legislative intent and should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 13    of  the Fifty-ninth Idaho Legislature, the Senate and the House of Representa-
 14    tives concurring therein, that IDAPA 15.04.01, Section 072, relating to Opera-
 15    tion of Compensation Plan, Subsection 05.b only,  Rules  of  the  Division  of
 16    Human  Resources  and  Personnel  Commission, as previously adopted as a final
 17    rule   under   Docket   Number   15-0401-0301,   and   renumbered   as   IDAPA
 18    15.04.01.072.06.b in Docket Number 15-0401-0601, be, and the  same  is  hereby
 19    rejected and declared null, void and of no force and effect.

                       STATEMENT OF PURPOSE

This concurrent resolution would reject a subsection of a final
rule of the Division of Human Resources and Personnel Commission.
The effect of this resolution, if adopted by both houses, would
be to remove the agency rule subsection from the Administrative
Code.
