1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE PUBLIC
3 HEALTH DISTRICTS RELATING TO RULES OF PANHANDLE HEALTH DISTRICT 1.
4 Be It Resolved by the Legislature of the State of Idaho:
5 WHEREAS, the Legislature is vested with authority to reject executive
6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
7 that the Legislature finds that the rules are not consistent with legislative
8 intent; and
9 WHEREAS, it is the finding of the Legislature that certain rules of the
10 Public Health Districts relating to Rules of Panhandle Health District 1 are
11 not consistent with legislative intent and should be rejected.
12 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
13 of the Fifty-ninth Idaho Legislature, the Senate and the House of Representa-
14 tives concurring therein, that IDAPA 41.01.01, Panhandle Health District 1,
15 Section 100, relating to Water Quality Control, Subsections 03.e and 03.f,
16 only, Rules of the Public Health Districts, as adopted as pending rules under
17 Docket Number 41-0101-0601, be, and the same are hereby rejected and declared
18 null, void and of no force and effect.

STATEMENT OF PURPOSE
RS 17181C2
This concurrent resolution would reject two (2) subsections of a
pending rule of the Public Health Districts pertaining to Rules
of the Panhandle Health District 1. The effect of this
resolution, if adopted by both houses, would be to prevent these
subsections of the agency rule from going into effect.
FISCAL NOTE
This concurrent resolution has no fiscal impact.
