  1                                  A JOINT RESOLUTION
  2    PROPOSING AN AMENDMENT TO SECTION 2, ARTICLE IX, OF THE  CONSTITUTION  OF  THE
  3        STATE  OF  IDAHO,  TO  PROVIDE THAT THE FAITHFUL EXECUTION OF ALL LAWS AND
  4        EDUCATION POLICIES ESTABLISHED BY THE IDAHO LEGISLATURE SHALL BE VESTED IN
  5        A STATE BOARD OF EDUCATION; STATING THE QUESTION TO BE  SUBMITTED  TO  THE
  6        ELECTORATE;  DIRECTING  THE  LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS
  7        REQUIRED BY LAW; AND DIRECTING THE  SECRETARY  OF  STATE  TO  PUBLISH  THE
  8        AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
                                                                        
  9    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 2, Article IX, of the Constitution of the State
 11    of Idaho be amended to read as follows:
                                                                        
 12             SECTION 2.  BOARD OF EDUCATION. The general supervision  of  the
 13        state  educational institutions and public school system of the state
 14        of Idaho, and faithful execution of all laws and  education  policies
 15        established by the Idaho legislature shall be vested in a state board
 16        of  education,  the  membership,  powers and duties of which shall be
 17        prescribed by law. The state  superintendent  of  public  instruction
 18        shall be ex officio member of said board.
                                                                        
 19        SECTION  2.  The  question to be submitted to the electors of the State of
 20    Idaho at the next general election shall be as follows:
 21        "Shall Section 2, Article IX, of the Constitution of the State of Idaho be
 22    amended to provide that the faithful execution of all laws and education poli-
 23    cies established by the Idaho Legislature shall be vested in a State Board  of
 24    Education?".
                                                                        
 25        SECTION  3.  The Legislative Council is directed to prepare the statements
 26    required by Section 67-453, Idaho Code, and file the same.
                                                                        
 27        SECTION 4.  The Secretary of State is hereby directed to publish this pro-
 28    posed constitutional amendment and arguments as required by law.

                       STATEMENT OF PURPOSE

The purpose of this legislation is to amend the Constitution of
the State of Idaho to provide that the Idaho State Board of
Education, in addition to its duties to provide general
supervision of the state educational institutions and public
school system of the State of Idaho, shall faithfully execute the
laws and education policies established by the Idaho legislature. 


                           FISCAL NOTE

It shall cost approximately $50,000 to put this issue on the
ballot at the next general election.
