  1                                        AN ACT
  2    RELATING TO ARCHITECTS; AMENDING CHAPTER 3, TITLE 54, IDAHO CODE, BY THE ADDI-
  3        TION OF A NEW SECTION 54-317, IDAHO CODE, TO AUTHORIZE THE BOARD TO INVES-
  4        TIGATE AND DISCIPLINE UNLICENSED INDIVIDUALS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Chapter 3, Title 54, Idaho Code,  be,  and  the  same  is
  7    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  8    ignated as Section 54-317, Idaho Code, and to read as follows:
                                                                        
  9        54-317.  AUTHORITY TO INVESTIGATE AND DISCIPLINE  UNLICENSED  INDIVIDUALS.
 10    (1)  The  board  may investigate any person engaged in architecture within the
 11    state of Idaho, or any person believed to have acted as an  architect  without
 12    being  duly  licensed  as  required by this chapter. Upon receipt of a written
 13    complaint from a person, the board shall perform an investigation of the facts
 14    alleged against such person. If the board investigation reveals that the facts
 15    alleged or received are sufficient to proceed with a formal action, the  board
 16    may  authorize  the  filing of an administrative complaint against such person
 17    and may seek injunctive relief prohibiting such person from  engaging  in  the
 18    practice of architecture.
 19        (2)  The  board  shall  have the authority to impose a civil penalty in an
 20    amount not to exceed two thousand dollars ($2,000) and recover the  costs  and
 21    fees incurred in an investigation and prosecution against any unlicensed indi-
 22    vidual who violates any provision of this chapter.

Adding section 54-317, Idaho Code, to allow the Board to 
investigate and discipline unlicensed individuals practicing 
architecture.


                        FISCAL IMPACT

There is no fiscal impact on general or dedicated funds.
