  1                                        AN ACT
  2    RELATING TO JUDGES; AMENDING SECTION 59-502, IDAHO CODE, TO INCREASE THE SALA-
  3        RIES OF SUPREME COURT JUSTICES AND DISTRICT COURT JUDGES.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 59-502, Idaho Code, be, and the  same  is  hereby
  6    amended to read as follows:
                                                                        
  7        59-502.  SALARIES OF JUDGES. (1) Commencing on July 1, 2006, the salary of
  8    the  justices of the supreme court shall be one hundred ten thousand five hun-
  9    dred dollars ($110,500) per annum, and the salary of the judges  of  the  dis-
 10    trict  courts  shall  be  one  hundred  three  thousand  six  hundred  dollars
 11    ($103,600)  per  annum. Commencing on July 1, 2007, the annual salaries of the
 12    justices of the supreme court and the annual salaries of  the  judges  of  the
 13    district courts shall be increased by five percent (5%).
 14        (2)  Salaries  of  magistrates shall be as prescribed by chapter 22, title
 15    1, Idaho Code.
 16        (3)  Salaries shall be paid on regular pay  periods  not  less  frequently
 17    than  monthly  as  determined  by order of the supreme court as due out of the
 18    state treasury, but no justice of the supreme court or judge of  the  district
 19    court  or  magistrate shall be paid his salary, or any part thereof, unless he
 20    shall first take and subscribe an oath that there is not in his hands any mat-
 21    ter in controversy not decided by him, which has been  finally  submitted  for
 22    his  consideration  and determination thirty (30) days prior to his taking and
 23    subscribing said oath.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16996

This bill would change the annual salary of justices of the supreme
court, judges of the court of appeals, district judges and attorney
magistrate judges beginning July 1, 2007.  The annual salaries of
the justices and judges would be increased by 5%.
                                
                                
                          FISCAL NOTE

The estimated fiscal impact of the increased cost of salary and
benefits, which are paid from the general fund, would be $803,825
for FY2008.
