2 RELATING TO SITING OF MANUFACTURED HOMES IN RESIDENTIAL AREAS; AMENDING SEC-
3 TION 67-6509A, IDAHO CODE, TO PROVIDE THAT A LOCAL GOVERNING BOARD MAY
4 ADOPT A STANDARD THAT PLACES CERTAIN LIMITS ON ROOF REQUIREMENTS OF MANU-
5 FACTURED HOMES AND MOBILE HOMES LOCATED OUTSIDE MOBILE HOME PARKS.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 67-6509A, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 67-6509A. SITING OF MANUFACTURED HOMES IN RESIDENTIAL AREAS -- PLAN TO BE
10 AMENDED. (1) By resolution or ordinance adopted, amended or repealed in accor-
11 dance with the notice and hearing procedures provided under section 67-6509,
12 Idaho Code, each governing board shall amend its comprehensive plan and land
13 use regulations for all land zoned for single-family residential uses, except
14 for lands falling within an area defined as a historic district under section
15 67-4607, Idaho Code, to allow for siting of manufactured homes as defined in
16 section 39-4105, Idaho Code.
17 (2) Manufactured homes on individual lots zoned for single-family resi-
18 dential uses as provided in subsection (1) of this section shall be in addi-
19 tion to manufactured homes on lots within designated mobile home parks or man-
20 ufactured home subdivisions.
21 (3) This section shall not be construed as abrogating a recorded restric-
22 tive covenant.
23 (4) A governing board may adopt any or all of the following placement
24 standards, or any less restrictive standards, for the approval of manufactured
25 homes located outside mobile home parks:
26 (a) The manufactured home shall be multisectional and enclose a space of
27 not less than one thousand (1,000) square feet;
28 (b) The manufactured home shall be placed on an excavated and backfilled
29 foundation and enclosed at the perimeter such that the home is located not
30 more than twelve (12) inches above grade;
31 (c) The manufactured home shall have a pitched roof, except that no stan-
32 dards shall require a slope of greater than a nominal three (3) feet in
33 height for each twelve (12) feet in width;
34 (d) The manufactured home shall have exterior siding and roofing which in
35 color, material and appearance is similar to the exterior siding and
36 roofing material commonly used on residential dwellings within the commu-
37 nity or which is comparable to the predominant materials used on surround-
38 ing dwellings as determined by the local permit approval authority;
39 (e) The manufactured home shall have a garage or carport constructed of
40 like materials if zoning ordinances would require a newly constructed
41 nonmanufactured home to have a garage or carport;
42 (f) No manufactured home or mobile home shall be required to have a sepa-
43 rate roof structure placed over the manufactured or mobile home, nor shall

1 any original roof of a manufactured home or mobile home be required to be
2 strengthened to a standard higher than the original structural design of
3 the manufactured or mobile home.
4 (g) In addition to the provisions of paragraphs (a) through (ef) of this
5 subsection, a city or county may subject a manufactured home and the lot
6 upon which it is sited to any development standard, architectural require-
7 ment and minimum size requirements to which a conventional single-family
8 residential dwelling on the same lot would be subjected.
9 (5) Any approval standards, special conditions and the procedures for
10 approval adopted by a local government shall be clear and objective and shall
11 not have the effect, either in themselves or cumulatively, of discouraging
12 needed housing through unreasonable cost or delay.
STATEMENT OF PURPOSE
RS 17007
The purpose of this amendment is to protect manufactured
homes and mobile homes from being required to have their roofs
rebuilt or a "snow roof" built over them in order to be eligible
to receive a setting or building permit if they are to be moved.
Additionally, it will prohibit municipalities from enacting a
"roof load requirement" that exceeds what the homes were
constructed to hold.

There is no fiscal impact on the general fund.
