CONSTITUTIONAL AMENDMENTS - Amends existing law to provide that the
Secretary of State shall cause to be printed in either the voters'
pamphlet, or in a pamphlet similar to the voters' pamphlet, the statements
prepared by the Legislative Council regarding submitted constitutional
amendments as well as the question that will be on the general election

  1                                        AN ACT
  2    RELATING TO STATEMENTS REGARDING PROPOSED CONSTITUTIONAL AMENDMENTS;  AMENDING
  3        SECTION  67-453,  IDAHO CODE, TO PROVIDE THAT THE SECRETARY OF STATE SHALL
  4        CAUSE TO BE PRINTED IN EITHER THE VOTERS' PAMPHLET OR IN A PAMPHLET  SIMI-
  5        LAR  TO  THE  VOTERS' PAMPHLET, THE STATEMENTS PREPARED BY THE LEGISLATIVE
  6        COUNCIL REGARDING SUBMITTED CONSTITUTIONAL  AMENDMENTS  AND  THE  QUESTION
  7        THAT  WILL BE ON THE GENERAL ELECTION BALLOT AND TO MAKE TECHNICAL CORREC-
  8        TIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Section 67-453, Idaho Code, be, and the  same  is  hereby
 11    amended to read as follows:
                                                                        
 12        67-453.  STATEMENTS  REGARDING  PROPOSED  CONSTITUTIONAL  AMENDMENTS.  (1)
 13    Whenever  the  legislature shall have directed the submission of a proposal to
 14    amend the constitution of the state of Idaho to the electors, the  legislative
 15    council  shall,  not less than one hundred twenty (120) days prior to the date
 16    of the election at which the proposed amendment will be submitted to the  peo-
 17    ple,  prepare  and  file  with the secretary of state a dossier containing the
 18    following:
 19        (1a)  aA brief statement setting forth in simple, understandable  language
 20        the  meaning  and  purpose  of the proposed amendment and the result to be
 21        accomplished by such amendment. The statement shall  be  included  in  the
 22        publications of the proposed amendment required by law of the secretary of
 23        state,  and shall be printed on the official ballot by which such proposed
 24        amendment is submitted to the electors; and
 25        (2b)  aA concise presentation of the major arguments advanced by the  pro-
 26        ponents  and  opponents of the proposed amendment designed to represent as
 27        fairly as possible the arguments relative to the  proposed  amendment.  In
 28        preparing  such arguments, the legislative council may seek the advice and
 29        suggestions of known supporters and opponents  or  any  other  persons  or
 30        groups  and  may,  in  its sole discretion, use any of the suggested argu-
 31        ments. If any such suggestions are utilized by the legislative council, no
 32        recognition shall be given to the persons or groups  which  submitted  the
 33        argument. The arguments shall be published in the publications required by
 34        law of the secretary of state, but shall not appear on the ballot by which
 35        such proposed amendment is submitted to the electors.
 36        (2)  The  secretary  of  state  shall  cause  to  be printed in either the
 37    voters' pamphlet pursuant to section 34-1812C, Idaho Code, or  in  a  pamphlet
 38    similar to the voters' pamphlet, the arguments prepared pursuant to subsection
 39    (1) of this section and the question that will be on the general election bal-
 40    lot.

The proposed legislation directs the Secretary of State to print and
distribute a voters  pamphlet with arguments in support and in
opposition for a proposed constitutional amendment as well as
initiatives.




                          FISCAL NOTE
                                
Information regarding constitutional amendments would be included in
the voters  pamphlet currently prepared for initiatives and would have
only a minor impact on the general fund for the additional pages. In
the event no initiative qualifies for the ballot, the cost of the
voters  pamphlet for a constitutional amendment would be approximately
$127,000.
