  1                                        AN ACT
  2    RELATING TO ELECTIONS FOR CREATION OF A NEW TAXING DISTRICT; AMENDING  CHAPTER
  3        8,  TITLE  63, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 63-802C, IDAHO
  4        CODE, TO PROVIDE FOR NOTIFICATION WHEN THERE IS TO BE AN ELECTION TO  CRE-
  5        ATE  A  NEW  TAXING DISTRICT, TO PROVIDE REQUIREMENTS OF THE NOTICE AND TO
  6        PROVIDE THE EFFECT OF THE NOTICE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 8, Title 63, Idaho Code,  be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 63-802C, Idaho Code, and to read as follows:
                                                                        
 11        63-802C.  ELECTION TO CREATE A NEW TAXING DISTRICT.  In  the  case  of  an
 12    election  to create a new taxing district, the county clerk, of  the county or
 13    counties where the proposed taxing district is proposed to be  located,  shall
 14    mail  a  notice  of  the election to all residences within the proposed taxing
 15    district or to residents in the proposed taxing district who are  eligible  to
 16    vote  in this election. The notice shall be mailed not less than fourteen (14)
 17    calendar days  prior  to  the  day  of  the  election  and  shall  state  with
 18    specificity:  the purpose of the election, the date of the election, the poll-
 19    ing places, the time the polls will be open, the  aggregate  amount  of  taxes
 20    that  will  be raised in the proposed  taxing district if the election is suc-
 21    cessful and the increase that will occur  per  one  hundred  thousand  dollars
 22    ($100,000)  of taxable value of property, above any exemptions, of residential
 23    property, commercial property, industrial property, land actively  devoted  to
 24    agriculture  and  operating  property.  The county clerk may bill the proposed
 25    taxing district for reimbursement of costs of administering this section. Com-
 26    pliance with this section shall satisfy any notice or publication  requirement
 27    as may be provided by law.

This legislation requires taxing districts, when holding an election to
create a new taxing district, to mail notices within fourteen (14) days
of such elections to property taxpayers. Notice by publication is
exempted.




                          FISCAL NOTE
