]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 383 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO SEXUAL OFFENDERS; AMENDING CHAPTER 83, TITLE 18, IDAHO CODE, BY 3 THE ADDITION OF A NEW SECTION 18-8330, IDAHO CODE, TO PROVIDE A PENALTY 4 FOR THIRD PARTY ASSISTANCE TO SEXUAL OFFENDERS ATTEMPTING TO AVOID SEXUAL 5 OFFENDER REGISTRATION REQUIREMENTS AND TO PROVIDE AN EXCEPTION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 83, Title 18, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 18-8330, Idaho Code, and to read as follows: 10 18-8330. THIRD PARTY ASSISTANCE TO SEXUAL OFFENDERS REQUIRED TO BE REGIS- 11 TERED -- EXCEPTION. (1) It is a felony for any person who has reason to 12 believe that a violent sexual predator is not complying, or has not complied 13 with, the requirements of this chapter and who, with the intent to assist the 14 violent sexual predator in eluding a law enforcement agency that is seeking to 15 find the violent sexual predator to question or arrest him because of noncom- 16 pliance, to: 17 (a) Withhold information from a law enforcement agency about the violent 18 sexual predator's noncompliance and, if known, withhold the whereabouts of 19 the violent sexual predator; 20 (b) Harbor, or attempt to harbor, or assist another person in harboring 21 or attempting to harbor, the violent sexual predator; 22 (c) Conceal, or attempt to conceal, or assist another person in conceal- 23 ing or attempting to conceal, the violent sexual predator; or 24 (d) Provide information to a law enforcement agency regarding the violent 25 sexual predator which the person knows to be false information. 26 (2) The provisions of this section do not apply if the violent sexual 27 predator is incarcerated in a federal, state or private correctional facility 28 or in a county jail.
STATEMENT OF PURPOSE RS 17609 This proposed legislation will add Idaho Code Section 18-8330 for the purpose of penalizing and deterring people from assisting individuals required to register as sex offenders from avoiding the registration requirements.
