                          BY RESOURCES AND CONSERVATION COMMITTEE

  1                                        AN ACT
  2    RELATING TO IRRIGATION DISTRICT  ELECTIONS;  AMENDING  SECTION  43-208,  IDAHO
  3        CODE,  TO  REVISE  TIME REQUIREMENTS RELATING TO THE CANVASS OF RETURNS BY
  4        BOARDS OF DIRECTORS.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 43-208, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:

  8        43-208.  CANVASS OF RETURNS. The board of directors must meet at its usual
  9    place  of meeting on or before the first Monday after each election to canvass
 10    the returns, and they shall proceed in the same manner and with  like  effect,
 11    as  near  as  may  be,  as the board of county commissioners in canvassing the
 12    returns of general elections, and when they shall have  declared  the  result,
 13    the  secretary  shall  make  full  entries in his records in like manner as is
 14    required of the county recorder in general elections. The board  of  directors
 15    must  declare elected the person or persons having the highest number of votes
 16    for each office. The secretary must, immediately, make out and deliver to such
 17    person or persons a certificate of election signed by  him  and  authenticated
 18    with the seal of the board.

                       STATEMENT OF PURPOSE

                             RS 17737


The purpose of this legislation is to allow Irrigation
District Board of Director's flexibility on the date of
canvassing elections, while retaining the deadline of the
Monday following the election to complete the canvass of
returns.




                          FISCAL IMPACT

There will be no fiscal impact to the State.
